Abstract:

Předmětem mé práce je vysvětlení pojmu veřejná podpora a grantový systém. Ráda bych zde vysvětlila, co je cílem kontroly veřejné podpory, na základě čeho vznikla potřeba této kontroly, její společenský kontext a význam. V jedné z kapitol bych chtěla vysvětlit také historický vývoj zákazu veřejné podpory a rovněž tak i současné chápání tohoto zákazu včetně aktuálně platné legislativy. V další části jsou popsány grantové systémy územních samosprávných celků, jejich jednotlivé aspekty, role i vysvětlení této podpory poskytované územními samosprávnými celky. Práce se zabývá mantinely legitimní veřejné podpory při grantových aktivitách územních samosprávných celků včetně případného dalšího možného vývoje tohoto zákazu. V praktické části práce je rozepsán proces řízení o podnětu, kterým se v České republice zabývá Úřad pro ochranu hospodářské soutěže, jehož rozhodovací pravomoci po vstupu do Evropské unie převzala Evropská komise. Dále jsou uvedeny příklady nedovolené veřejné podpory. Závěr práce obsahuje stručné shrnutí získaných poznatků.

Abstract:

The purpose of my work is to explain the aforementioned terms „Public Subsidy“ and „Grant System“. I would like to explain what is the purpose of the public subsidy control, based on what a need for such a control has arisen from, its social context and meaning. The aim of one of the following chapters is to describe the public subsidy ban genesis, as well as its current understanding, including the legislation currently being in force. Another chapter describes grant systems of the self-governing regions and municipalities, their aspects and purposes, inluding explanation of their function. The work focuses on the legal barriers of the public support, coherent to the grant activities taken by self-governing entities including further eventual possible development of these barriers. The application part of this work describes the incentive procedure administered by the Economic Competition Protective Authority of the Czech Republic, whose decision-making powers have been taken over by the European Commission upon entering the EU. The closing part of this work briefly summarizes the ackquired findings and knowledge.
