Abstract:

Cílem diplomové práce je srovnat státní příslušnost a domicil, tradiční hraniční určovatele, které mají v různých oblastech rozdílný význam. V historii se prosazovala vazba na stát nebo na území. V současnosti se většinově prosazuje spíše vazba na území. Práce se zabývá historickým vývojem dvojice hraničních určovatelů, které jsou spolu spjaty: státní příslušnost vs. domicil. V rámci evropského práva se objevuje hraniční určovatel bydliště, který obsahuje řadu kritérií, jež vyjadřují určitou vazbu na území. Může se jednat o obvyklý pobyt či obvyklé bydliště. V práci jsou uvedeny důvody, které vedly k jednoznačnému prosazení a vítězství hraničního určovatele bydliště. Dále je zde uveden vzájemný vztah mezi bydlištěm a obvyklým pobytem (či obvyklým bydlištěm). V následující části se autorka zabývá užitím bydliště v jednotlivých sledovaných oblastech, jako jsou jednotlivé části kolizního práva a užití domicilu v oblasti procesní. Uvádíme také jeho jednotlivé varianty, tedy trvalý pobyt, přechodný a dlouhodobý pobyt. Autorka se v této práci snaží vymezit pojem obvyklého pobytu v rámci českého právního řádu. Na závěr zhodnotí bydliště ve vzájemné komparaci s obvyklým pobytem a obvyklým bydlištěm. Diplomová práce se také zabývá otázkou, zda obvyklý pobyt představuje synonymum k pojmům bydliště a obvyklé bydliště. V rámci práce autorka uvádí i příslušnou judikaturu soudů, aby vytvořila ucelený pohled na danou problematiku.

Abstract:

The thesis shall primarily focus on the comparison of nationality and domicile, on the traditional connecting factors which have diverse meanings in different areas. In the past the binding on the state and territory was advocated whilst today the majority promotes the binding on the territory. The thesis strives to provide the reader with an extensive historical development of both connecting factors which are doubtlessly linked together: nationality vs. domicile. In terms of European law the connecting factor domicile appears quite frequently and contains a rather numerous list of criteria which expresses a certain connection to the territory. These would be the habitual residence and habitual domicile. The thesis proceeds to examine the reasons which led to an unambiguous enforcement of the connecting factor of residence. Furthermore the thesis contains an analysis of the mutual relationship between the habitual residence and the ordinary residence. The next chapter proceeds to analyze the use of residence in individually monitored areas contained in conflict of laws and the usage of domicile in the subject matter. The author also included all individual variants of residence such as permanent residence, sojourn, abiding residence and the definition of habitual residence within the Czech legislature. Finally, the thesis shall tackle an evaluation of the concept of residence and its mutual connection to habitual residence and habitual domicile as well as the question whether the term habitual residence contains any similarities with the term residence and habitual domicile. All of this above will be supported by relevant case law to form a comprehensive view on the subject.
