Unfair Commercial Practices in Relation to Consumer

Abstract:

Diplomová práce se zaměřuje na téma nekalé obchodní praktiky ve vztahu ke spotřebiteli. Téma práce se týká oblasti práva, která se dotýká nás všech, ať už malých dětí, dospělých nebo starých lidí.Tato práce se zaměřuje na nekalé obchodní praktiky v oblasti B2C (business-to-customer), neboli řeší nerovné postavení mezi podnikatelem a spotřebitelem.Cílem práce je vyhodnotit situaci v oblasti nekalých obchodních praktik ve vztahu ke spotřebiteli na území České republiky, tj. jedná se o vyhodnocení práv těchto osob v oblasti spotřebitelského práva. Zjistit, zda spotřebitelé znají svá práva a jsou dostatečně chráněni. Dále zjistit, zda spotřebitelé dokáží rozpoznat nekalou obchodní praktiku. Na konec zjistit, zda průměrní spotřebitelé představují většinu v České republice.V diplomové práci byly použity následující metody. Zejména se jedná o popis, analýzu a syntézu zkoumaných jevů. V praktické části práce byla použita metoda dotazování, následná analýza a vyhodnocení získaných údajů.V rámci práce se vycházelo ze tří hypotéz. Za prvé, že stále existují tzv. šmejdi, již využívají slabých stránek spotřebitelů. Za druhé, že spotřebitelé dostatečně neznají svá práva v oblasti nekalých obchodních praktik. Za třetí, že spotřebitele lze snadno oklamat, a proto procento průměrných spotřebitelů na území České republiky je menší, než se předpokládá.Na konci práce se podařilo zjistit, že tzv. šmejdi se stále vyskytují, však využívají jiných metod k oklamání spotřebitelů než dříve. Další závěrem je, že i když by se většina z reprezentativního vzorku dotazníkového šetření nenechala oklamat na základě otázek, staví se spíše k empirickému modelu spotřebitele, která hledí na spotřebitele jako na slabší stranu, jež je nepozorná a lze ji lehce oklamat. Dále, že v některých oblastech práv spotřebitele nejsou spotřebitelé dostatečně informováni. Na konec v rámci návrhů na zlepšení se zjistilo, že by veřejnost nejvíce uvítala medializaci tématu nekalých obchodních praktik a zlepšení kontroly dozorčích orgánů jako je např. Česká obchodní inspekce.

Abstract:

The diploma thesis focuses on unfair commercial practices in relation to consumer. The subject of the thesis concerns the field of law, which applies to every person, from small children across adults to elderly people.The thesis focuses on unfair commercial practices in B2C area (business-to-customer), i.e. unequal position between operator and consumer.The purpose of the thesis is to evaluate situation of unfair commercial practices in relation to consumer in the Czech Republic, i.e. evaluation of rights of those people in the area of consumer law. Another purpose is to ascertain if consumers know their rights and they are sufficiently protected. Last purpose is to find out if average consumers represent the majority in the Czech Republic.There were used following methods in the thesis. Mainly there was used description, analysis and synthesis of the examined data. In practical part of the work there was used method of questioning, following analysis and evaluation of obtained data.There were three crucial hypotheses during writing the thesis. First of all, so called trash-traders still exist and také advantage of weak sides of consumers. Second of all, consumers do not sufficiently know their rights in the area of unfair commercial practices. Last hypothesis is that the percentage of average consumers in the Czech Republic is lesser than it is supposed.At the end of the thesis it was ascertained out that so called trash-traders still occur, but they use different methods to deceive consumer than before. Next conclusion is that although most of the presentable sample of the questionnaire research would not be deceived on the basis of the questions, they agree with empirical model of consumer behavior, when consumer is not attentive and could be easily deceived. Next, consumers are not sufficiently informed in some areas of consumer law. At the end it was ascertained that the public would mostly appreciate media coverage of unfair commercial practices and improvement of inspection of supervisory authorities, for example the Czech Trade Inspection Authority.
