Efficienty of regulation and supervision of investment markets

Abstract:

Diplomová práce je zaměřena na regulaci a dohled nad trhy s investičními nástroji s důrazem zejména na české obchodníky s cennými papíry jako jedny z nejdůležitějších hráčů na trhu s investičními nástroji. Před rozborem činnosti samotného obchodníka cennými papíry bylo třeba vysvětlit, s čím vůbec obchodník cennými papíry může obchodovat, jaké může investorovi nabídnout investiční služby nebo investiční nástroje. Diplomová práce obsahuje srovnání různých systémů dozoru a dohledu, legislativní základy a nastiňuje též trendy ve vývoji regulace dohledu trhů s investičními nástroji. Podrobně je rozebrána úloha a funkce obchodníka s cennými papíry, je zhodnocena právní úprava od jejího vzniku až po současnost a samozřejmě je zdůrazněn nejvýznamnější trend ke zefektivnění regulace a dohledu nad obchodníkem s cennými papíry. Zároveň diplomová práce popsala možnosti měření efektivnosti regulace a dohledu nad obchodníkem cennými papíry, jak je vůbec možné měřit efektivnost regulace a dohledu a jaké faktory ovlivňují efektivnost regulace a výkon dozoru. Jako výstup můžeme konstatovat, že projevem efektivnosti regulace a dohledu je finanční stabilita jako jedna z nejdůležitějších charakteristik existujícího ekonomického systému. Nicméně nesmí být opomenuto, že nejdůležitějším faktorem rozvoje kapitálového trhu v naší zemi je jeho důvěryhodnost, a proto pro regulaci a dohled je nezbytná politická podpora a veřejný zájem.

Abstract:

Abstract The thesis is aimed to regulation and supervision of investment markets, particularly emphasizing Czech securities traders belonging to the most important players on investment markets. Before considering the activity of the security trader as such, it was necessary to explain the object traded with by the security trader, and investment tools or services offered to the investor. The thesis has drawn a comparison of various systems of surveillance and supervision, legislation, and outlined development trends in regulation of investment markets supervision. The role of the security trader is considered thoroughly with its legal framework studied and compared since its origination up tp this day. The most important trend of strengthening efficiency of regulation and supervision of the securities trader is a matter of course. Simultaneously, however, the thesis presents the possibility of measurement of the efficiency of regulation and supervision of the securities trader, it details how at all the efficiency of regulation and supervision can be measured, and what are the factors influencing the efficiency of regulation and suveillance. It can be stated as a result that financial stability is a proof of efficiency of regulation and supervision. It is, however, necessary to bear in mind that the most important factor influencing the development of the capital market in our country is its, therefore political support and public interest are necessary for the regulation and supervision.
