Aserting rights of physicaly handicaped people on the labour market

Abstract:

Práce se zabývá tím, jakým způsobem je možné prosazovat práva nezaměstnaných zdravotně postižených osob na trhu práce, zejména právo na práci. Autor nejprve vymezuje pojem zdravotního postižení na základě medicínského a sociálního přístupu. Následně jsou představeny nejdůležitější dokumenty týkající se oblasti lidských práv zdravotně postižených osob, zejména jejich práva na práci. Poté je definován samotný pojem práva na práci a jeho dílčích částí včetně jejich promítnutí v právních předpisech České republiky. Diskutována je vazba mezi právem na práci a jednotlivými nástroji politiky trhu práce. V praktické části autor zkoumá, jakým způsobem může brněnský úřad práce a vybraná nezisková organizace prosazovat právo na práci zdravotně postižených osob v brněnském regionu. Zjišťuje cíle těchto organizací, skladbu jejich klientů, jaké konkrétní nástroje politiky pracovního trhu používají, zda existuje vazba mezi těmito nástroji a právem na práci a jaké mají výsledky. Výzkum byl postaven na zpracování dat, které byly získány v rámci rozhovorů s oslovenými pracovníky vybraných organizací a na sekundární analýze statistických dat a dokumentů. Výzkum potvrdil existenci řady faktorů bránících uplatňování práva na práci zdravotně postižených osob. Počet slov: 12442

Abstract:

The submitted diploma thesis focuses on ways and means of accomplishing rights of unemployed disabled persons on the labour market, especially the right of employment. First and foremost, the author defines the terminus of disability based on medical and social model. Subsequently, the pivotal documents concerning the sphere of human rights of disabled persons with a special regard to the right of employment, are presented. In the following part, the terminus of right of employment itself and its individual parts are defined including its projection in the legal regulation of the Czech Republic. Further, the connection between the right of employment and the individual instruments of the labour market policy is discusses. In the empirical part the author pays attention to the way in which both the Labour Office located in Brno and the chosen non-profit organization can fulfil the right of employment of disabled persons in the region of Brno. The aims followed by these organizations, the structure of their clients, the particular instruments of the labour market policy they use, the existence of a linking of these instruments to the right of employment and the results of the activities performed by these two organizations are made a subject of the author’s research. The research was based on the procession of data obtained from the interviews with the addressed workers of the chosen organizations and on a secondary analysis of the statistic data and documents. The research has proofed the existence of a high number of factors inhibiting the disabled persons from the realization of the right of employment. Number of words: 12442
