The beginning and the end of the legal personality

Abstract:

Tato diplomová práce se zabývá právní úpravou počátku a konce právní osobnosti člověka, jakož i přesahům působení před okamžik narození a po smrti této osoby. První kapitola vymezuje obecné informace ohledně právní osobnosti, svéprávnosti a zmiňuje uplatňování osobnostních práv, kterými člověk disponuje. Druhá kapitola se zabývá vznikem právní osobnosti, ale také obdobím tomu předcházejícím - od početí po narození. Zmíněny jsou také pohledy z oblasti filozofické, etické či náboženské. Třetí kapitola odpovídá na otázku, v jakém okamžiku může nasciturus práva nabývat, kdy mu jsou přiznána a co se s těmito stane, pokud se nasciturus nedožije okamžiku narození. Tuto část také doplňují zmínky o manipulaci s lidskými zárodky. Čtvrtá kapitola vymezuje obsah statusových změn v postavení člověka během života, a to od standartních, jako je manželství a rodičovství, po ty méně časté od změny jména, příjmení po změnu rodného čísla aj. Poslední kapitola týkající zániku právní osobnosti je zaměřena na určení okamžiku jejího zániku - smrti, ale také přesahu do postmortální ochrany osobnosti a nároků a práv k problematice se vztahujícím. K nejkontroverznější problematice kapitoly patří téma euthanasie a asistované sebevraždy, tedy konce právní osobnosti, o kterém by mohl každý rozhodnout samostatně v situacích striktně vymezených a upravených zákonem, ale, bohužel, tyto instituty nejsou v českém právu dosud zakotveny, tudíž je jejich provedení, ač na žádost, nelegální, konkrétně by takové jednání bylo hodnoceno jako trestný čin. V některých kapitolách je pro účely komparace zmíněna také problematika právnických osob, které právní osobností v určitém rozsahu také disponují.

Abstract:

This diploma thesis deals with the legal regulation of the beginning and the end of a legal personality, as well as influence of such regulation before the moment of birth and after the death. The first chapter defines general information regarding legal personality, autonomy and mentions the application of personal rights that a person has. The second chapter deals with the establishment of legal personality and also with the previous period, from conception to birth. Perspectives of the philosophical, ethical or religious spheres are also mentioned. The third chapter answers the question at what moment a nasciturus can acquire the rights, when they are granted, and what happens to them if the nasciturus does not live to see the moment of birth. This part of the thesis also adresses manipulation of human embryos. The fourth chapter defines the content of changes in a person's status during life, from standard ones, such as marriage and parenthood, to the less frequent from change of name, surname to change of birth number, etc. The last chapter concerning legal dissolution is focused on determining demise - death, but also the overlap into the post-mortem protection of the personality and claims and rights related to the issue. In addition to death, it is also necessary to mention the unclear situation around demise, namely the declaration of a person as dead by a court. One of the most controversial issues in the chapter is the topic of euthanasia and assisted suicide, ie the end of legal personality, which anyone should be able to independently decide for themselves in situations strictly defined and regulated by law, but, unfortunately, these institutes are not yet enshrined in Czech law, so their implementation even if upon request is illegal, in particular, such conduct would be considered a criminal offense. In some chapters, for the purposes of comparison, the issue of legal persons is also mentioned, which also possess legal personality to a certain extent.
