Financial arbitrator of the Czech Republic and his role in consumer protection

Abstract:

Bakalářská práce se zabývá finančním arbitrem České republiky jako institutem pro mimosoudní řešení sporů na finančním trhu a jeho významem pro ochranu práv spotřebitele finančních produktů. Je představen legislativní rámec ochrany spotřebitele na finančních trzích, zejména nový český zákon o spotřebitelském úvěru, a instituce působící na poli ochrany spotřebitele. Dále je podrobně představena samotná kancelář finančního arbitra a je popsán průběh řízení před arbitrem, se zohledněním připravovaných změn. V závěru je finanční arbitr porovnán s obdobnými instituty působícími v dalších státech Evropské unie. Práce taktéž nabízí autorovy kritické úvahy nad současným pojetím ochrany spotřebitele na finančním trhu a náměty k případným změnám.

Abstract:

The thesis discusses the financial arbitrator of the Czech Republic as an institute of alternative dispute resolution on financial markets and his purpose in protection of consumers of financial services. First, the legislative framework of consumer protection is described, especially new Czech law on consumer credit. Then, the financial arbitrator itself is discussed, along with proposed changes of the institute. Finally, the thesis compares the Czech financial arbitrator with similar bodies in other member states of the European Union - France, Slovakia and Ireland. The thesis also includes the author's personal reflections on the matter.
