The legal mode of buildings on foreign land

Abstract:

Právní úprava majetkových vztahů k pozemku a nemovitosti zřízené na tomto pozemku prošla historickým vývojem. Zatímco obecný občanský zákoník z roku 1811 uplatňoval zásadu římského práva superficies solo cedit, podle níž nemovitá stavba je součástí pozemku a je tedy také ve vlastnictví vlastníka pozemku. Postupným legislativním vývojem byly z této zásady činěny výjimky. Podle občanského zákoníku z roku 1950 nemovité stavby již byly samostatnými věcmi v právním smyslu a vlastníkem nemovité stavby mohla být i osoba odlišná od vlastníka pozemku. V současné době platná právní úprava vychází ze zásady, že stavba postavená neoprávněně na cizím pozemku je ve vlastnictví stavebníka. Historický vývoj od přijetí obecného zákoníku občanského v r. 1811 jsem podrobněji popsala v úvodu práce a navázala jsem současnou praxí v rozhodování sporů vyplývajících z vlastnictví neoprávněných staveb. V současné době řešení situace stavby na cizím pozemku vychází z platného zákona č. 40/1964 Sb., občanský zákoník ve znění pozdějších předpisů, konkrétní úprava je obsažena v § 119 a § 120, kde jsou definovány nemovitosti a dále je řečeno, že stavba není součástí pozemku. § 135c občanského zákoníku pak říká, že zřídí-li někdo stavbu na cizím pozemku, ač na to nemá právo, může soud na návrh vlastníka pozemku rozhodnout, že stavbu je třeba odstranit na náklady toho, kdo stavbu zřídil. Při rozhodování o odstranění stavby musí soud přihlédnout k hledisku účelnosti takovéhoto zásahu. Účelnost je nutno posuzovat objektivně a individuálně v každém jednotlivém případě. Shledá-li soud, že odstranění stavby není účelné, přikáže za náhradu stavbu vlastníkovi pozemku. Při stanovení výše náhrady za zřízení věcného břemene soudem musí soud přihlédnout k ceně pozemku, ke kterému se věcné břemeno zřizuje, k výši nájemného, jehož by bylo možno v dané době a v daném místě za pronájem tohoto pozemku dosáhnout a k míře omezení vlastníka pozemku. Vlastník musí s tímto postupem vyjádřit souhlas. Soud může uspořádat poměry mezi vlastníkem pozemku a vlastníkem stavby i jinak, tj. může zejména ve prospěch stavebníka neoprávněné stavby zřídit za náhradu věcné břemeno (zejména se bude jednat o zřízení práva příchodu a přístupu), které je nezbytné k výkonu vlastnického práva k nemovité stavbě. Výše uvedené postupy při řešení otázky stavby na cizím pozemku lze považovat za taxativní, což znamená, že soudu není dána jiná možnost uspořádat vztahy mezi vlastníkem stavby a vlastníkem pozemku než stanovenými způsoby. Aktivně legitimovanou osobou k podání návrhu na odstranění neoprávněné stavby na cizím pozemku je vlastník pozemku. Soud může upravit vztahy vyplývající z existence neoprávněné stavby i na návrh neoprávněného stavebníka či jeho právního nástupce.

Abstract:

The legal regulation of proprietary relations to land and real property established on such a land has gone through historical development. While the Common Civil Code of 1811 applied the Roman law principle superficies solo cedit according to which a structure is the component part of the land and thus it is also the property of the land’s owner. In the course of legislative development, exceptions have been made to this principle. According to the Civil Code of 1950, structures had already been regarded as separate things in the legal sense and even a person different from the land’s owner could be the owner of the structure. Legal regulation currently in force is based upon a principle that a structure built without authorization on the land of another is the property of the owner of the structure. In the introductory part of the work, I enlarged upon the historical development since the adoption of the Common Civil Code of 1811 and I proceeded with the current practice in resolution of disputes resulting from ownership of unauthorized structures. At present, the resolution of the situation regarding structures built on a land of another is based on Act No. 40/1964 Coll., the Civil Code, as amended, being in force, the particular regulation is contained in Sections 119 and 120 providing for the definition of a real property and further stating that a structure is not the component part of the land. Section 135c of the Civil Code then provides that should any person create a structure on a land of another without being authorized thereto the court may, upon the motion of the land’s owner, adjudicate that the structure be removed at the cost of the person having created the structure. In deciding on the removal of the structure, the court must take into account the aspect of purposefulness of such an action. The purposefulness must be considered objectively and individually in each particular case. Should the court find the removal of the structure as non-purposeful, it will assign the structure to the land’s owner against compensation. In determination of the amount of compensation for the judicial creation of easement, the court must take into consideration the price of the land with respect to which the easement is being created, the amount of rent for the land in question achievable at the given time and in the given location and the extent of restriction of the land’s owner. The owner must express its consent to such a procedure. The court may also settle the relationships between the land’s owner and the structure’s owner in a different manner, i.e. it may in particular create an easement for the benefit of the builder of the unauthorized structure against compensation (it will, in particular, be the right of entry and access) which is necessary for the exercise of the ownership right to the structure. The above mentioned procedures in resolving the issue of a structure on the land of another may be regarded as taxative which means that the court is provided with no option other than to settle the relationships between the structure’s owner and the land’s owner through the stipulated procedures. The person having the locus standi to file a motion for the removal of unauthorized structure on the land of another is the land’s owner. The court may also regulate the relationships resulting from the existence of the unauthorized structure upon the motion of the unauthorized builder or its legal representative.
