Abstract:

Má diplomová práce na téma "Právní aspekty směnárenské činnosti" se nejprve zabývá historií směnného obchodu a devizového práva, ze kterého směnárenská činnost vychází. Třetí kapitola se zaměřuje na platidla české měny, mezi která řadíme bankovky a mince. Popisuje jednotlivé ochranné prvky bankovek, včetně jejich znázornění. Čtvrtá kapitola je zaměřena na měnu euro, která výrazně ovlivňuje Českou republiku v souvislosti s jejím vstupem do Evropské unie. Měna euro je častým předmětem směny ve směnárnách, neboť ji užívá několik států v eurozóně, a proto zde popisuji i eurobankovky, euromince a jejich ochranné prvky. Pátá kapitola je věnována směnárenské činnosti v platné právní úpravě. Součástí této kapitoly se nachází podrobný rozbor tohoto zákona o směnárenské činnosti a zákona, který nabude účinnosti 1. 4. 2019 se zaměřením na rozdílnost těchto úprav. Poslední šestá kapitola obsahuje aktuální problémy směnárenské činnosti, především nekalé praktiky směnáren a z pohledu směnárenství jsou to problémy s padělanými penězi a praní špinavých peněz.

Abstract:

My diploma thesis on "Legal aspects of the currency exchange" deals in the first part with the history of the swap trading and foreign exchange law, on which the currency exchange is based. Chapter 3 focuses on the legal tender of the Czech currency, which are banknotes and coins. It describes individual security features of the banknotes, including their visualization. Chapter 4 focuses on the euro currency, which has a great influence on the Czech Republic in relation to its membership in the European Union. The euro currency is a frequent subject of exchange in the exchange offices because it is used in several countries of the eurozone, and therefore I also describe euro banknotes, euro coins and their security features. Chapter Five deals with to the currency exchange in its current legislation. A part of this chapter is a detailed analysis of the Act on the currency exchange coming into effect as of April 1, 2019, focusing on the differences of those legislations. The last Chapter Six includes the current issues of the currency exchange, predominantly the unfair practices of exchange offices and the problems of counterfeit money and money laundering from the perspective of currency exchange offices.
