Usage of Proper Names in Denomination of Laws in Ancient Rome and the Czech Republic

Abstract:

Tato bakalářská práce se zabývá užíváním vlastních jmen v názvech římských zákonů (zjednodušené základní schéma „lex + vlastní jméno“) a srovnáním uvedené konstrukce s označováním zákonů v České republice. Práce je členěna na šest kapitol, z nichž úvodní vymezuje cíle a metody práce, zatímco závěrečná shrnuje její výsledky. Druhá kapitola představuje v základních rysech zákon (lex) v kontextu římského práva, jakož i další prameny, které lze chápat jako leges v širším smyslu, naznačen je i průběh legislativního procesu. Čtvrtá kapitola se věnuje názvu zákona z ústavněprávního pohledu a tvoří spojnici mezi hlavními částmi této práce, tedy třetí a pátou kapitolou. Třetí kapitola se věnuje jednotlivým způsobům označování římských zákonů, a to oficiálnímu i neoficiálnímu. Pátá kapitola se pak obdobným způsobem věnuje označování zákonů České republiky. Pro snazší orientaci čtenáře je na konec práce coby příloha vložena tabulka, přehledně shrnující jednotlivé typy označení. Římané užívali pro označení zákona nejčastěji adjektivní formy rodového jména navrhovatele (e. g. lex Falcidia). Zřídka se však vyskytují i jiné konstrukce, kupříkladu označení genitivem přivlastňovacím (e. g. oratio Marci), označení dle místa vzniku pravidla (lex Rhodia) či dle osoby, jejíž jednání bylo inspirací pro přijetí právní úpravy (senatusconsultum Macedonianum). Též lze pozorovat dvojtvary, kdy se vedle standardního označení codex Iustinianeus vyskytuje, a to častěji, i prostě připojené codex Iustinianus. V rámci oficiálního označování zákonů v České republice se vlastní jména nevyskytují, snad jen ve výjimečných případech coby předmět zákona (e. g. Zákon č. 143/1947 Sb., o převodu vlastnictví majetku hlubocké větve Schwarzenbergů na zemi Českou). Neoficiálně se však často užívá schématu „lex + vlastní jméno“ (e. g. lex Schwarzenberg, lex Šejna). Pravidlem tak je, narozdíl od práva římského, označení dle osoby, jejíž jednání bylo inspirací k přijetí právní úpravy. Pozorovat lze ale i označení jménem tvůrce zákona (e. g. lex Eliae, lex Šámal). Typicky jsou tato označení vytvářena prostým připojením jména, tak jako codex Iustinianus. Vyskytují se však i jiné případy (lex Eliae). Užívání schématu „lex + vlastní jméno“ je v češtině problematické i z hlediska gramaticko-syntaktického. V prvé řadě je třeba zdůraznit, že lex je ženského rodu, pročež jsou konstrukce typu „lex byl přijat“ nanejvýš nevhodné. Kromě toho je třeba mít na paměti, že latina (stejně jako čeština) využívá skloňování (lex, legis, legi, legem, lex, lege; v plurálu pak leges, legum, legibus, leges, leges, legibus), jehož absence (a ta je v laických, ale i v některých odborných textech velmi častá) značně ztěžuje porozumění textu. Problematická je rovněž odpověď na otázku, zda by mělo být skloňováno i jméno připojené k termínu lex, to by ovšem bylo povětšinou velmi složité, neboť většina českých či počeštěných jmen neumožňuje elegantní skloňování souvztažně s latinským substantivem lex.

Abstract:

This bachelor thesis deals with the use of proper names in denomination of Roman laws (simplified scheme "lex + proper name") and compares this structure with denomination of laws in the Czech Republic. The thesis consists of six chapters. The introductory one defines objectives of the thesis and the methods used, while the final one summarizes the results. The second chapter introduces basic features of law (lex) within the frame of Roman law, as well as of other sources of Roman law, that can be understood as leges in a broader sense; it also addresses the legislative procedure in ancient Rome. The fourth chapter deals with the denomination of a law from a point of view of constitutional law and serves as a conjunction of the thesis’ main parts, i. e. third and fifth chapter. The third chapter analyses various types of denominating laws in ancient Rome, both official and unofficial. The fifth chapter does the same concerning the laws in the Czech Republic. For the convenience of the reader, there is a table as an attachment at the end of the thesis, summarizing the types of denominating the laws in ancient Rome. To denominate a law, the Romans usually used an adjectival form of the nomen gentile of the sponsor (rogator) of the bill (e. g. lex Falcidia). Sometimes, however, a law was denominated in a different manner, such as via genitivus possessivus (e. g. oratio Marci) or according to the place of origin of the rule (lex Rhodia) or according to the person whose conduct was the inspiration for the enactment of a law (senatusconsultum Macedonianum). Sometimes more than one type of denomination is attested, e. g. regular denomination codex Iustinianeus appears rarely, whereas simply connected codex Iustinianus is very common. In the official denomination of laws in the Czech Republic, there are no proper names apart from exceptional cases, in which the proper name constitutes part of the law’s subject matter (e. g. Act No. 143/1947 Coll., On the transfer of ownership of Hluboká branch of the house Schwarzenberg to the Czech state). Unofficially, however, the scheme "lex + proper name" is often used (e. g. lex Schwarzenberg, lex Šejna). Usually, unlike in Roman law, the denomination is made according to the person whose conduct was the inspiration for enactment of a law. Sometimes, the denomination according to creator of the law appears, too (e. g. lex Eliae, lex Šámal). The denomination is usually created by simply adding the name, as in case of codex Iustinianus. However, there are other cases as well (lex Eliae). Usage of the scheme "lex + proper name" in Czech language is quite problematic concerning grammatical and syntactical structures. At first, it should be emphasized that lex is feminine – this fact is often neglected in Czech texts. In addition, the Latin language (as well as the Czech one) uses declension (lex, legis, legi, legem, lex, lege; in plural leges, legum, legibus, leges, leges, legibus), that omitted (it happens even in scientific texts quite often) causes understanding the text difficult. Another problem is declension of the Czech proper name connected with the Latin noun lex, because the structure of Czech names usually does not enable declining in a way suitable to be connected with the Latin noun lex.
