Franchising in the Czech Republic

Abstract:

Práce rozebírá tematiku franchisingu. Je rozdělena na teoretickou a praktickou část. V první části nejprve vysvětluje výrazy, které se s franchisingem pojí, následně uvede definici franchisingu a jeho právní úpravu. Pokračuje vývojem této formy podnikání jak ve světě, tak v České republice, a dále seznámí s vybranými asociacemi, které v dané oblasti působí. Následuje přehled kladných i záporných aspektů, s nimiž se účastníci franchisingového vztahu setkají, a je nastíněno, jaká kritéria hrají roli při uskutečňování výběru protistrany tohoto vztahu. V teoretické části jsou taktéž zmíněny cesty, jak vznikají franchisingové podniky, a jsou podány informace týkající se pilotního provozu. Další část práce se zabývá franchisingem u společnosti McDonald´s ČR, spol. s r. o. Po charakteristice společnosti a objasnění úlohy franchisingu právě ve vybraném řetězci rychlého občerstvení je přistoupeno k vysvětlení, jakým konkrétním způsobem probíhá proces od požádání o franchisu až k jejímu eventuálnímu získání. Poté praktická část informuje o aktuálním a pro zajímavost i minulém stavu druhů licencí McDonald´s, a přidává rozdělení finančních povinností mezi franchisorem a franchisantem v případě přímé licence. V předposlední kapitole objasňuje, v čí režii je výběr lokalit pro restaurace McDonald´s, a je uzavřena krátkou kapitolou o Ing. Karlu Sukovi, jež je prvním franchisantem zvolené společnosti. Poslední kapitola odkazuje na vybrané otázky z online rozhovoru právě s tímto franchisantem, jež jsou k dispozici v Příloze C, která zajišťuje kompletnost praktické části práce.

Abstract:

The work is divided into theoretical and practical part and deals with franchising theme. The first part explains expressions associated with franchising topic and gives its definition and regulation. Then the development of this type of business worldwide and in the Czech Republic is described and selected associations that operate in franchising area are mentioned. After that theoretical part shows positive and negative aspects which can participants in franchising relationship meet with. The criteria considered before counterparty is chosen are outlined also. In the first part is thereafter discussed about the ways how the franchise business can be formed the information about pilot operation are given. Next part deals with the franchising of McDonald´s ČR, spol. s r. o. company. After the company characteristics clarifying of the role of franchising in McDonald´s follows. Significant part of practical part of the work relates to explanation what the process of applying for the franchise to its eventual acquisition is held. Afterwards this part gives an overview of current and past kinds of McDonald´s licenses and distribution of financial obligations between the franchisor and franchisee in the case of direct license is added. In the last but one chapter is elucidated who chooses locations where restaurants are placed and practical part is concluded by short chapter about Ing. Karel Suk who is the first franchisee of McDonald´s company. The last chapter also refers to selected questions from the online interview with this franchisee. Interview is available in Enclosure C which ensures the completeness of the practical part.
