Democratic Deficit in the Functioning of the EU, namely in the Law-making Procedure and its Possible Overcoming

Abstract:

Tato práce se zabývá problematikou demokratického deficitu v Evropské unii, především v jejím legislativním procesu. Jejím cílem je odpovědět na otázku, zda je v prostředí unijní normotvorby skutečně nedostatek demokracie, vysvětlit příčinu a důsledky tohoto fenoménu a navrhnout možná zlepšení současné situace. Věnuji se rozboru demokratického zřízení a aplikaci zjištěných skutečností na poměry EU. Vymezuji rozdíl mezi institucionálním a percepčním demokratickým deficitem, analyzuji charakteristiku unijních orgánů z tohoto pohledu, jejich úlohu v legislativní činnosti EU a právní prameny upravující tuto oblast. Na základě zjištěných poznatků se přikláním k názoru, že demokratický deficit v EU a jejím legislativním procesu existuje. Je způsobený nevyváženými pravomocemi unijních institucí v mechanizmech EU, a to především velkým vlivem nevolených unijních orgánů v procesu tvorby legislativních aktů oproti postavení přímo voleného Evropského parlamentu a malou účastí vnitrostátních parlamentů. Důsledkem je, že tyto legislativní akty nejsou přijímány ve zcela demokratickém prostředí zastupitelského orgánu. Tento nedostatek je možné potlačovat posilováním úlohy přímo volených institucí v procesech fungování EU, při zachování cílů Evropské unie v její současné podobě jej bohužel ale zcela odstranit nelze.

Abstract:

The main purpose of this thesis is an analysis and explanation of a democratic deficit in the functioning of the European union, namely in the law-making procedure and its possible overcoming. Its aim is to answer the question, if there is a lack of democracy in the EU´s law-making, to explain the cause and the consequence of this phenomenon and to sugggest a possible improvement of current situation. I analyze attributes of democratic system and I apply discovered facts to the situation in the EU. I define the difference between institutional and perceptual democratic deficit, I analyze the characteristic of EU´s institutions and theirs role in the law-making procedure from this point of view, as well as the law which determines this field. On the base of discovered findings I tend to the opinion that a democratic deficit exists in the EU and in its law-making procedure. It is caused by unbalanced competences of EU´s institutions, mainly by big influence of non-voted authorities in the law-making in the EU in comparision with directly voted European parliament and with a low participation of member states parliaments. The consequence is that these law acts are not created in fully democratic environment of representativ authority. This lack of democracy is possible to reduce by supporting of role of directly voted authorities in functioning of the EU. But it is not possible to fully eliminate a democratic deficit in current position of EU.
