Process of parliamentary controll off security forces and intelligence services

Abstract:

Bakalářská práce se zaměřuje na oblast parlamentní kontroly bezpečnostních sborů a zpravodajských služeb České republiky jako specifické kontrolní činnosti. Seznamuje s jejím vývojem po vzniku samostatné České republiky a ustavením stálých kontrolních komisí jako parlamentního kontrolního nástroje, jejich činností a pravomocemi, případně limity. První část práce se zabývá charakteristikou základních pojmů, historií zpravodajských služeb a jejich náplní. Druhá část se zaměřuje na vlastní kontrolu zpravodajských služeb, její složitost v kontextu utajování informací vzhledem k existenci „tenké“ hranice mezi získáváním informací, jejich využitím a zveřejňováním a potřebou zákonodárné moci tuto oblast kontrolovat. V závěru se pokouší zhodnotit nově vzniklý nástroj kontrolní činnosti, a to Orgán nezávislé kontroly, který by měl k uvedenému účelu sloužit, a zda se tak opravdu podaří naplnit literu zákona po posledních volbách do Poslanecké sněmovny na podzim roku 2021 v souvislosti se změnou politického rozložení sil v zákonodárném sboru.

Abstract:

The bachelor’s thesis focuses on the sphere of parliamentary control of security inspectorates and reporting services of the Czech Republic as specific control activities. The thesis provides information in the area of development of parliamentary control after constituting independent Czech Republic and establishing steady control commissions as parliamentary control tool and their activities, competences and eventual limits. The first part deals with the charecteristics of basic expressions, the history of reporting services and their scope of employment. The second part deals with own control of reporting services, its complexity in connection with information concealing with respect to existence of fine line between gathering information, its exploitation and publication and need of legislative to control this sphere. In conclusion the thesis is trying to assess the newly created control activities tool, respectively Independent Control Authority, which should be instrumental to the alleged purpose and whether it will be succeeded in fulfilment of the letter of the law after last elections to the Chamber of Deputies held in autumn in 2021 in connection with change of political power balance in legislature.
