The Influence of the Constitution of Cádiz on the Constitutional Charters of the Former Spanish Colonies in Latin America and Particularly in Peru

Abstract:

Tato diplomová práce se zabývá vlivem cádizské ústavy z roku 1812 na ústavní vývoj v bývalých španělských koloniích v Latinské Americe, se zaměřením na Peru. Práce prozkoumává historický kontext španělské kolonizace a význam cádizské ústavy jako základního kamene pro další ústavní listiny v regionu. Podrobně se věnuje analýze spojení mezi politickými, sociálními transformacemi a ústavním vývojem, od období kolonizace, přes boje o nezávislost, až po vznik nových státních útvarů. Práce porovnává cádizskou ústavu s první peruánskou ústavou z roku 1823, zdůrazňuje společné demokratické principy a rozdíly ve struktuře a aplikaci. Význam cádizské ústavy je posuzován v kontextu jejího dlouhodobého dopadu na liberální a reprezentativní principy vlády v Latinské Americe. Práce tak přispívá k hlubšímu pochopení ústavního vývoje v regionu a jeho historických kořenů.

Abstract:

This thesis deals with the influence of the Constitution of Cádiz on the constitutional charters of the former Spanish colonies in Latin America, particularly Peru. The thesis studies historical context of Spanish colonization and the importance of the Cadiz Constitution as a cornerstone for other constitutional charters in the region. It analyzes in detail the links between political and social transformations and constitutional development, from the period of colonization, through the struggles for independence, to the creation of new state formations. The work compares the Cádiz constitution with the first Peruvian constitution of 1823, highlighting common democratic principles and differences in structure and application. The significance of the Cadiz Constitution is considered in the context of its long-term impact on liberal and representative principles of government in Latin America. The work thus contributes to a deeper understanding of constitutional development in the region and its historical roots.
