Legal and Criminological Aspects of Imposing and Enforcement of the Protective Education

Abstract:

Předmětem této diplomové práce jsou právní a kriminologické aspekty ukládání a výkonu ochranné výchovy jako jednoho z opatření soudnictví ve věcech mládeže. Práce se relativně samostatně zabývá pojmem a účelem ochranné výchovy ve vztahu k trestně odpovědným mladistvým na jedné straně a k trestně neodpovědným mladistvým a dětem mladším patnácti let na straně druhé. Pozornost je věnována vymezení hmotněprávních i procesních aspektů ukládání ochranné výchovy, obsažených nejen v zákoně č. 218/2003 Sb., o soudnictví ve věcech mládeže, nýbrž vyplývajících též z mezinárodně uznávaných standardů ochrany základních práv a svobod a sankcionování mládeže. Práce se rovněž zabývá analýzou potenciálního kriminogenního dopadu některých ustanovení zákona č. 109/2002 Sb., o výkonu ústavní nebo ochranné výchovy ve školských zařízeních, upravujících výkon ochranné výchovy. V návaznosti na zjištěné právní i faktické problematické aspekty ochranné výchovy v její současné podobě a na základě komparace s právní úpravou některých jiných zemí, zejména Slovenské republiky, má práce poskytnout doporučení de lege ferenda.

Abstract:

The diploma thesis deals with the theme of Legal and Criminological Apects of Imposing and Enforcement of the Protective Education as one of the youth jurisdiction measures. The thesis analyses the notion and the purpose of the protective education relatively separately concerning criminally responsible juveniles on the one side and children under the fifteen years of age and juveniles without criminal responsibility on the other side. Both substantive and procedural aspects of imposing protective education are defined not only on the basis of the Act No. 218/2003 Coll. but also regarding the internationally accepted standards relating to the protection of human rights and imposing sanctions on the youth. The thesis then discusses the potential criminogenic impact of legal provisions regulating enforcement of the protective education, included in the Act No. 109/2002 Coll. Further to determined current legal and actual problematic aspects of the protective education and on the basis of comparison with legislation in other states, especially in Slovak republic, the thesis formulates recommendations de lege ferenda.
