Role of the Court of Justice of the European Union in the education policy

Abstract:

This diploma thesis deals with the influence of the Court of Justice of the European Union (CJEU) on the policy of European education and its role in the area of student rights. The aim is to find out if CJEU influences an area which, based in primary law, falls largely within the scope of sovereignty of the Member States and to what extent. Based on the theory of neofunctionalism, the influence is examined by the use of the concept of spill-over, which helps to identify the areas in which the pressures for the integration of European education arise. Based on the spillover, it is also examined how are these pressures reflected in the area of the rights of EU students. An important aspect is the interest of the Member States in this area and their relationship with CJEU. The analysis of key court judgments and advocate-general's proposals, demonstrates to the CJEU plays an important role in strengthening the rights of EU students from the adoption of the Rome Treaties onwards, often despite the disagreement of the Member States.

Abstract:

Diplomová práca sa zaoberá vplyvom Súdneho dvora Európskej únie (SDEÚ) na politiku európskeho vzdelávania a jeho úlohy v oblasti študentských práv. Cieľom je zistiť, či preniká do oblasti, ktorá na základe primárneho práva spadá do oblasti suverenity členských štátov, a do akej miery. Vychádzajúc z teórie neofunkcionalizmu je tento vplyv posudzovaný pomocou využitia konceptu spill-over, ktorý napomáha identifikovať, v ktorých oblastiach vznikajú tlaky na integráciu európskeho vzdelávania. Na základe spill-overu je ďalej nahliadané na to, ako sa tieto tlaky prejavujú v ovplyvňovaní práv študentov EÚ. Dôležitým aspektom sú záujmy členských štátov v tejto oblasti, ktoré práca posudzuje aj na základe ich vzťahu so SDEÚ. Analýza kľúčových rozsudkov a návrhov generálnych advokátov dokazuje, že SDEÚ zohráva dôležitú úlohu v posilňovaní práv študentov EÚ od prijatia Rímskych zmlúv až po súčasnosť, a to častokrát aj napriek nevôli členských štátov.
