Abstract:

Bakalářská práce s názvem ochrana spotřebitele je zaměřena na právní úpravu ochrany spotřebitele v rámci České republiky, ale i Evropské unie. Cílem práce je poskytnout ucelené informace o české a evropské právní úpravě ochrany spotřebitele, představit problematiku české právní úpravy této oblasti a ověřit stanovenou hypotézu, která byla zvolena následovně: Dochází k řádné a bezchybné transpozici evropských směrnic v oblasti ochrany spotřebitele. První kapitola práce se zaměřuje na základní pojmy spojené s touto oblastí, jako je spotřebitel a podnikatel. Druhá kapitola se zabývá soukromoprávní ochranou spotřebitele, konkrétně spotřebitelskými smlouvami. Třetí kapitola je o samotné české právní úpravě spotřebitele a nepřípustných ujednání. Čtvrtá kapitola je zaměřena na úpravu evropskou. Poslední kapitola popisuje rozdíly mezi českou a evropskou úpravou, popisuje nedostatky a hodnotí nově navrhovanou právní úpravu ochrany spotřebitele.

Abstract:

The bachelor's thesis entitled consumer protection is focused on consumer protection legislation not only in the Czech Republic, but also in the European Union. The aim of the work is to provide comprehensive information about the Czech and European consumer protection legislation, to introduce the issue of Czech legislation in this area and to verify the established hypothesis, which was chosen as follows: There is a proper and error-free transposition of European directives in the field of consumer protection. The first chapter focuses on the basic concepts associated with this area, such as consumer and entrepreneur. The second chapter deals with private consumer protection, specifically consumer contracts. The third chapter is about the Czech consumer legislation and inadmissible arrangements. The fourth chapter focuses on the European regulation. The last chapter describes the differences between the Czech and European legislation, describes the shortcomings and evaluates the newly proposed consumer protection legislation.
