Abstract:

Predmetom diplomovej práce je analýza horizontálnych účinkov práva na priaznivé životné prostredie, a to pretože môže byť vhodným nástrojom na riešenie neustále klesajúcej kvality životného prostredia. Táto práca hľadá odpovede na následovné otázky: Kto sa môže dovolávať práva na priaznivé životné prostredie? Kto je nositeľom povinností zodpovedajúcich takémuto právu? Ako vlastne právo na priaznivé životné prostredie pôsobí v občianskoprávnych vzťahoch? Práca poukazuje na konceptuálne i interpretačné rozdiely medzi hlavnými doktrínami horizontálneho účinku ľudských práv. Cieľom práce je konceptuálne pripraviť pôdu k aplikácii práva na priaznivé životné prostredie v súkromnom práve. Neoddeliteľnou súčasťou práce je preto stručná analýza inštrumentálnych možností práva medzinárodného a európskeho, a aj komparatívne porovnanie relevantných ústavných noriem.

Abstract:

The diploma thesis focuses on the horizontal effect of the human right to the environment inasmuch it appears as an instrument to address constantly declining environmental quality. These are the research questions: Who may invoke the right to the healthy environment? Who might be a duty-bearer of duties stemming from such a right? How does the right effect in civil relations? The thesis aspires to show the conceptual and interpretation distinction between major doctrines of the horizontal effect of human rights. It aims to pave the way for the right to the environment to become effective within the ambit of private law. To respond to its aspirations the thesis outlines and briefly analyses international law instruments, European law and refers to different constitutional norms comparatively.
