Role and competencies of pilot-in-command

Abstract:

Práce se zabývá rolí a pravomocemi velitele letadla v leteckém provozu. Rozebírá právní úpravu letectví z hlediska vnitrostátní právní úpravy, evropského práva a mezinárodních dohod. Charakterizuje specifičnost role velitele letadla a práva a povinnosti upravující jeho řídící činnost na palubě letadla. Podrobně se věnuje otázce, zda velitel letadla vystupuje jako úřední osoba a uvádí příklady z letové praxe při řešení krizových situací. Z provedeného rozboru právních předpisů z oblasti trestního a správního práva a soudní judikatury práce dovozuje, že velitel letadla vystupuje při ochraně veřejného zájmu v krizových situacích jako úřední osoba.

Abstract:

The thesis deals with the role and competencies of the pilot in air traffic. It analyzes the legal regulation of aviation in terms of national legislation, European law and international agreements. It characterizes the specificity of the role of the pilot in command and the rights and obligations governing his management activity on board the aircraft. It deals in detail with the question of whether the pilot in command acts as a person in authority and gives examples of flight practice in crisis situations. From the analysis of the legislation in the area of criminal and administrative law and judicial case law, it concludes that the pilot in command acts as a person in authority in the protection of the public interest in crisis situations.
