Bill of Exchange as a Means of Ensuring the Business Debts

Anotácia:

Obsahem této práce je směnka a její využití jako zajišťovacího nástroje dluhu. Práce prezentuje praktické využití směnky, při využití směnečného práva v podnikání. Směnka představuje frekventovaný nástroj financování, ovšem odborné znalosti uživatelů mohou být nedostatečné či mylné. Tato práce se tedy snaží představit uplatnění směnky i její náležitosti. Snahou práce je poskytnout přehled tak, aby obě strany předešly možným problémům, které mohou plynout z nepochopení aspektů praktické implementace směnky. Práce je členěna na jednotlivé kapitoly, které identifikují směnku jako obecný i specifický instrument. Dále je v práci řešena podstata struktury směnky, z hlediska její požadované platnosti a samotný vývoj směnky i příslušné legislativy. Dále již práce představuje praktické využití směnky a výhody a nevýhody využití směnky z pohledu remitenta i dlužníka. Závěr práce se zabývá zhodnocením cílů a komplexních zjištěných dat a skutečností.

Abstract:

The content of this work is the bill of exchange, and its use as a hedging instrument of debt. The work presents practical use of bills of exchange, of exchange in the use of law in business. The promissory note is a frequent tool of financing, but the expertise of users may be inadequate or misguided. This paper will attempt to introduce the application of the bill of exchange, and its requirements. The effort is to provide an overview of work so that both sides avoid potential problems that may arise from a misunderstanding of the practical aspects of the implementation of the bill of exchange. The work is divided into chapters that identify the bill of exchange as a general and a specific instrument. The study also dealt with the essence of the structure of the bill in terms of the desired and the actual development of the relevant bills of exchange legislation. Furthermore already work presents practical use of promissory notes and advantages and disadvantages of the use of bills of exchange in terms of money remitters and borrower. Finally, the work deals with the evaluation objectives and the complex of data and facts.
