Illegal enterprise

Abstract:

This bachelors thesis is focused on offence of unauthorized enterpreneurship, which is involved to offences threating market economy, adjusted in the first section of the fifth head separated section of Criminal law with title Economic offences. First chapter describes economic offences generally and subsequently looks to offences threating market economy closer such as abusement of participation in competition, unauthorized enterpreneurship, unauthorized alcohol production and so on. Second chapter is focused on protection of market economy in Slovak republic´s condition and author describes terms like enterpreneur, enterprise and enterpreneurship within the meaning of Commercial code and also Licensing code. The most extensive part thesis is the third chapter which includes criminal sanction of illegal actions against market economy, level of crime rates for these offences, sanctioning illegal offenses associated with enterpreneurship out of Criminal law´s system and also activities of courts and law enforcement authorities in sanctioning of unauthorized enterpreneurship. The last chapter describes control and prevention of unauthorized enterpreneurship. The work is mainly based on the literature and also the latest legislation.

Abstract:

Predložená bakalárska práca je zameraná na trestný čin neoprávneného podnikania, ktorý je zaradený medzi trestné činy ohrozujúce trhovú ekonomiku, upravené v prvom diely piatej hlavy osobitnej časti Trestného zákona s názvom Trestné činy hospodárske. Prvá kapitola všeobecne popisuje trestné činy hospodárske a následne sa bližšie venuje trestný činom ohrozujúcim trhovú ekonomiku ako napríklad zneužitiu účasti na hospodárskej súťaži, neoprávnenému podnikaniu, nedovolenej výrobe liehu a pod. Druhá kapitola je zameraná na ochranu trhovej ekonomiky v podmienkach Slovenskej republiky, pričom autor popisuje pojmy podnikateľ, podnik a podnikanie v zmysle Obchodného zákonníka ako aj v zmysle Živnostenského zákona. Najrozsiahlejšiu časť práce tvorí tretia kapitola, ktorá zahŕňa trestnoprávny postih protiprávnych konaní proti trhovej ekonomike, výšky trestných sadzieb za tieto trestné činy, postihovanie protiprávnych deliktov súvisiacich s podnikaním mimo systém trestného práva, ako aj činnosť súdov a orgánov činných v trestnom konaní pri postihovaní neoprávneného podnikania. Posledná kapitola stručne charakterizuje kontrolu a prevenciu pred neoprávneným podnikaním. Práca sa opiera o odbornú literatúru a najnovšiu právnu úpravu.
