Abolition of the death penalty in the Czech Republic

Abstract:

Ve své Diplomové práci se zabývám zrušením trestu smrti v České republice, jak z úzkého, tak i širokého hlediska. Práce je rozdělena do dvou částí, a to na teoretickou část a praktickou část. Teoretická část se věnuje historii trestu smrti na našem území až do jeho zrušení a vyjmutí z právního řádu České republiky. Dále se také teoretická část zabývá druhy trestu smrti, justičními omyly a vraždami na našem území. Práce zmiňuje náhled a postoj k trestu smrti v dnešní společenské situaci. V praktické části je vyhodnocen dotazník, jehož cílem bylo zjistit, jak se laická veřejnost staví k trestu smrti a jeho znovuzavedení, jak je spokojena s naším justičním systémem a zda společnost důvěřuje našemu nynějšímu justičnímu systému. Tato diplomová práce se skládá z jedenácti kapitol, kdy každá pojednává o různých aspektech trestu smrti. První kapitola se zaměřuje na pojem trest smrti. V druhé kapitole jsem se zaměřila na historii trestu smrti na našem území od středověku až do jeho zrušení. Popisuji, o jaké zákony se trest smrti opíral a v jakých zákonech byl zakotven. Třetí kapitola pojednává o druzích trestu smrti na území nynější České republiky, a to od počátku až do jeho zrušení, které nastalo v roce 1990. Čtvrtá kapitola je věnována kriminalitě v době po rekodifikaci zákona a zaměřuje se na legislativu a dynamiku četnosti kriminality. Pátá kapitola pojednává o pachatelích závažných trestných činů na území České republiky. Šestá kapitola pojednává o zrušení trestu smrti na našem území a jeho vyjmutí z právního řádu. Sedmá kapitola rozebírá základní lidská práva a svobody. U osmé kapitoly se dočteme o vnitrostátním a mezinárodním právní úpravě související s trestem smrti. Devátá kapitola nám pojednává o výjimečném trestu, jako náhradě trestu smrti. Dále v desáté a jedenácté kapitole následuje praktická část, kde jsou vyhodnoceny získaná data z dotazníkového šetření.

Abstract:

In my Diploma thesis, I deal with the abolition of the death penalty in the Czech Republic, both from a narrow and a broad point of view. The work is divided into two parts, the theoretical part and the practical part. The theoretical part is devoted to the history of the death penalty in our territory until its abolition and removal from the legal system of the Czech Republic. Furthermore, the theoretical part also deals with the types of death penalty, miscarriages of justice and murders in our territory. The work mentions the outlook and attitude towards the death penalty in today's social situation. In the practical part, a questionnaire is evaluated, the aim of which was to find out how the lay public views the death penalty and its reintroduction, how satisfied they are with our justice system, and whether society trusts our current justice system. This thesis consists of eleven chapters, each of which deals with different aspects of the death penalty. The first chapter focuses on the concept of the death penalty. In the second chapter, I focused on the history of the death penalty in our territory from the Middle Ages until its abolition. I describe what laws the death penalty was based on and in what laws it was enshrined. The third chapter deals with the types of death penalty in the territory of the current Czech Republic, from the beginning until its abolition in 1990. The fourth chapter is devoted to crime in the period after the re-codification of the law and focuses on the legislation and the dynamics of the crime rate. The fifth chapter deals with perpetrators of serious crimes in the territory of the Czech Republic. The sixth chapter discusses the abolition of the death penalty in our territory and its removal from the legal system. The seventh chapter discusses basic human rights and freedoms. In the eighth chapter, we will learn about national and international legislation related to the death penalty. The ninth chapter tells us about exceptional punishment, as a substitute for the death penalty. Furthermore, in the tenth and eleventh chapters, there is a practical part, where the data obtained from the questionnaire survey are evaluated.
