The Czech Republic before the Human Rights Committee

Abstract:

Výbor pro lidská práva OSN je orgánem složeným z nezávislých expertů z oblasti lidských práv, který dohlíží na to, jestli smluvní strany Mezinárodního paktu o občanských a politických právech dodržují jeho ustanovení. Tato práce se Výborem pro lidská práva zabývá z hlediska České republiky. V první části je popsána činnost Výboru pro lidská práva a jeho hlavní monitorovací mechanismy – hodnocení periodických zpráv o dodržování ustanovení Paktu podávaných smluvními stranami a oznámení jednotlivců na základě Opčního protokolu k Mezinárodnímu paktu o občanských a politických právech. Druhá část se zabývá periodickými zprávami podanými Českou republikou, následnými vyjádřeními Výboru pro lidská práva a legislativními a jinými změnami, které Česká republika na základě doporučení Výboru provedla. Třetí část je věnována analýze stížností jednotlivců na porušování práv zakotvených v Paktu Českou republikou.

Abstract:

United Nations Human Rights Committee is a body of independent human rights experts that monitors the implementation of the International Covenant on Civil and Political Rights by its State parties. This thesis examines the activities of the Human Rights Committee from the point of view of the Czech Republic. The first chapter describes the work of the Human Rights Committee and its main monitoring mechanisms – examination of periodic reports submitted by State parties and consideration of individual complaints under the Optional Protocol to the International Covenant on Civil and Political Rights. The second chapter deals with the periodic reports submitted by the Czech Republic, subsequent concluding observations of the Human Rights Committee and actions taken by the Czech Republic to implement recommendations of the Committee. The third chapter analyzes individual complaints against the Czech Republic where individuals claim to be victims of the violations of the rights set forth in the International Covenant on Civil and Political Rights.
