Other entities of central government - institutional comparison

Abstract:

Tzv. jiné ústřední správní orgány jsou právně vymezeny z části v tzv. kompetenčním zákoně a dále v řadě zvláštních právních předpisů, v nichž je zpravidla konkrétně upravena působnost těchto správních úřadů. Z institucionálního hlediska se jiné ústřední správní orgány jeví jako poměrně jednolitá skupina, přestože mezi nimi najdeme různě organizačně konstruované instituce. Diplomová práce se ve své stěžejní části zaměřuje na vzájemné porovnání jiných ústředních správních orgánů z organizačního hlediska, zejména pak na základě tzv. organizačně-technických principů, a to s cílem identifikovat, zda existuje pro zřizování a organizační uspořádání těchto úřadů dostatečná legislativní základna. Práce se taktéž zabývá poněkud nezřetelně definovanou skupinou tzv. nezávislých správních orgánů. V závěru práce jsou předloženy vlastní názory na (ne)dostatečnou existující ústavní i zákonnou úpravu dané problematiky a nastíněna možná řešení de lege ferenda.

Abstract:

The so-called other entities of central government are legally defined partially in the Competence Act and in a number of specific legal acts that describe scope of competence of these state bodies more in detail. From an institutional point of view, other entities of central govern-ment appear as quite cohesive group, despite the fact that they may have slightly different institutional design. The thesis focuses mainly on the comparison of other entities of central government from an organisational point of view. The comparison analysis will be based on so-called organisational-technical principles, in order to identify whether there is a sufficient legislative base for the establishment and organisational setting of these bodies. The thesis also deals with a vaguely defined group of so-called independent authorities. We will present views on the (non-)sufficient constitutional and legal regulation in this area and suggest possible de lege ferenda solutions.
