Reform of the State Administration in the Czech Republic: Case of the Civil Service Act

Abstract:

Diplomová práce se zabývá reformou státní správy v České republice. Kvalita státní správy patří k důležitým politickým i ekonomickým tématům. Přijetím zákona o státní službě mělo být docíleno depolitizace, stabilizace a profesionalizace úřednického aparátu. Cílem práce je analyzovat legislativní proces přijímání zákona o státní službě v politickém kontextu a zaměřit se na to, jestli pozměňovací návrhy a obstrukce sledovaly naplnění profesionální a nepolitické státní správy nebo naopak sledovaly snížení kvality přijímaného zákona. Dílčím cílem je zhodnotit, jestli současná úprava zákona o státní službě naplňuje vize profesionální a nepolitické státní správy. Diplomová práce je rozdělená do 4 kapitol. První část práce se zabývá státní správou v teoretické rovině. Druhá kapitola obsahuje historický exkurz do problematiky státní správy na území ČR od roku 1848 do současnosti. Třetí praktická kapitola představuje hlavní dokumenty reformy státní správy a v nich obsažené vize, kterých by státní správa měla dosáhnout. Dále je zde analyzován proces přijímání zákona o státní službě a jsou zde identifikovány jeho největší problémy. Poslední kapitola se zaměřuje na samotný zákon o státní službě a hodnotí ho v rámci naplňování vizí reformy státní správy.

Abstract:

The master´s thesis focuses on the reforming of the Czech civil service. The quality of the state administration is one of the most important political and economic topics. By passing the Civil Service Act the representatives aimed at depoliticization, stabilization and professionalization of the situation of civil servants. The main goal is to evaluate the law-making process of the Act and find out if the amendatory proposals and obstructions had the professional and apolitical state administration in view or aimed at lowering of the quality of this Act. Also, the objective is to assess, if the Act meets the requirements stated in the documents regarding the reforming of the Czech civil service. The master´s thesis is divided into four chapters. The first part of the thesis covers the state administration in theory. The second chapter contains a historical overview of the state administration in the territory of the Czech Republic from 1848 up to the present day. The third chapter presents the main documents regarding the reform and their key requirements. Furthermore, the law-making process is analysed and his crucial problems are identified. The final part concentrates on the Civil Service Act and evaluates it with reference to the main requirements stated within the reform.
