Employment of Foreigners in the Czech Republic

Abstract:

Obsahem této bakalářské práce je zaměstnávání zahraničních pracovníků v České republice v souladu se zákonem č. 435/2004 Sb., o zaměstnanosti, ve znění pozdějších předpisů. Z důvodu hlubšího porozumění dané problematiky se v úvodu zabývám migrací obyvatel a legislativou Evropské unie tematicky související. Nedílnou součástí je i krátké zhodnocení makroekonomických ukazatelů ovlivňujících situaci na trhu práce a vysvětlení základních pojmů. Následuje podrobný popis postupů při zaměstnávání cizích státních příslušníků a rozdílů při zaměstnávání občanů Evropské unie a cizinců ze třetích zemí, včetně specifických případů. Práce poukazuje na změny v oblasti zaměstnávání cizinců, které přinesla novela zákona o zaměstnanosti účinná od 1. ledna 2009. Závěr je zaměřen na problematiku tzv. „zelených karet“ a nelegálního zaměstnávání cizinců.

Abstract:

The present bachelor thesis deals with the employment of foreign workers in the Czech Republic in compliance with the Act No. 435/2004 Coll., on employment, as amended. To facilitate the understanding of the topic the migration of population in and the relevant legislation of the European Union are discussed in the introductory part. Integral part of the thesis is also a brief evaluation of the macroeconomic factors influencing the situation in the labor market and an explanation of the basic terms. This is followed by a detailed description of procedures related to the employment of foreign workers, and of differences available in this particular field between the EU citizens and those from third party countries. Specific cases are also mentioned. The changes in the employment of foreign workers brought about by an amendment to the Employment Act that came into effect on January 1, 2009 are explained. The closing part deals with the question of the so-called Green Cards and with the problem of illegal employment of foreign nationals.
