Abstract:

Bakalářská práce se zabývá způsoby skončení služebního poměru příslušníků bezpečnostních sborů, ukazuje na specifika služebního poměru v porovnání s pracovním poměrem dle zákoníku práce a možnostmi jeho ukončení. Samostatná kapitola je věnována základním rozdílům mezi oběma poměry s výhodami i nevýhodami obou pojetí, včetně nároků, které s jejich ukončením souvisí. Součástí práce je i širší výklad o vzniku služebního poměru, o omezeních, která příslušníkům bezpečnostních sborů vznikají, a jeho změnách. Důraz je kladen na vysvětlení systému záloh a ustanovení na služební místo, který úzce souvisí s možnostmi ukončení služebního poměru. Cílem práce není předložit pouze čistou komparaci způsobů ukončení obou druhů zaměstnaneckých vztahů, ale zasadit celé téma do reálné situace v bezpečnostních sborech a vystihnout zásadní rozdíly, které současná právní úprava služebního a pracovního poměru přináší.

Abstract:

The bachelor´s thesis deals with ways of termination of service contract of security forces members, points out the specifics of service contract in comparison to employment according to the Labour Code and ways of termination including legitimate claims. A separate chapter is devoted to basic differences between service contract and employment and their advantages and disadvantages. Another part of the thesis is an interpretation of service contract commencement, restrictions resulting from service contract of security forces members and changes of service contract. The accent is put on the explanation of service position appointment and system of reserves, which is closely connected with ways of termination of service contract. The aim of the thesis is not only to present the comparison of ways of termination between service contract and employment, but also to put the whole topic into a real situation in security forces and to express the main differences caused by contemporary legal regulations of service contract and employment.
