Possibilities of the employer's insurance against work injuries

Abstract:

Tato bakalářská práce se zabývá možnostmi pojištění podnikatele pro řešení důsledků pracovních úrazů. Cílem této práce je zanalyzovat nedostatky zákonného pojištění odpovědnosti zaměstnavatele za pracovní úrazy a nemoci z povolání v České republice. Zkoumané téma je aktuální, jelikož jeho současná právní úprava je dlouhodobě nevyhovující. V teoretické části práce je popsán historický vývoj odpovědnosti zaměstnavatelů za pracovní úrazy a nemoci z povolání zaměstnanců a následného pojištění této odpovědnosti. Další kapitoly se věnují možným přístupům k této problematice a podrobné právní úpravě v České republice. Závěr teoretické části popisují navazující komerční pojištění, kterými je možné zákonné pojištění doplnit. V praktické části je jako modelový příklad použita malá anonymní akciová společnost. Je provedena analýza některých touto společností uzavřených komerčních pojištění v porovnání se zákonným pojištěním odpovědnosti zaměstnavatele. Na závěr jsou nedostatky aktuální právní úpravy zhodnoceny z pohledu obecného i individuálního společnosti XZ.

Abstract:

This bachelor thesis on insurance options for employers of dealing with the consequences of workplace injuries and occupation diseases. Its main aim is to analyse shortcomings of statutory insurance of the employer's responsibility for work injuries and occupation diseases in the Czech Republic. This topic is quite resent because its legislation is insufficient. The theoretical part of this thesis presents historical development, descriptions of several possible approaches to this problem and a detailed analysis of the current legislation in the Czech Republic. Related commercial insurance products are also described in this part. The practical part of this thesis uses small anonymous company XZ as an example. Several commercial insurances of this company are analysed and compared to the statutory insurance. Last but not least, the thesis evaluates shortcomings of the statutory insurance from the point of view of the company XZ as well as from the general point of view.
