International Responsibility for Acts Committed on Uncontrolled Territory of the State: Selected Arabic States

Abstract:

Tato práce se zabývá otázkou odpovědnostních vztahů za činy páchané na území Iráku, Sýrie a Libye. Jedná se o případovou studii vybraných arabských států. Práce nejprve shrnuje historické souvislosti, poté u Libye a Sýrie pojednává o průběhu Arabského jara a v případě Iráku se zabývá vývojem od stažení amerických vojsk 2011. V analytické části je pojednáno, zda vyjmenované státy představují failed states, nebo jim lze přičítat odpovědnost za činy páchané na jejich území. Dále je hodnocena legitimita subjektů, které vykonávají moc nad částí území a samy sebe prohlašují za jediného zástupce lidu. Není opomenuta ani otázka mezinárodněprávního postavení tzv. Islámského státu a jeho odpovědnosti. Je pojednáno i o legitimitě zapojení mezinárodního společenství do probíhajících konfliktů. Závěrem jsou v práci shrnuty rozdíly ve vnitrostátním postoji i mezinárodní reakci na průběh ozbrojených konfliktů.

Abstract:

This thesis deals with the question of the responsibility relations for acts committed on the uncontrolled territory of Iraq, Syria and Libya. It is the case study of selected Arab states. The dissertation firstly summarizes the historical connections, then it discusses the evolution of the Arab Spring in Libya and Syria and in the case of Iraq, it considers the evolution after the American withdrawal 2011. In the analytical part, there is the treatise on whether the discussed states are failed states or whether their governments may be held responsible for acts committed on their territory. The legitimacy of subjects that govern or exercise their power over a part of territory and declare themselves as the representative of the people is also mentioned. Neither the question of the position of the so-called Islamic state is forgotten, nor the question of its responsibility. It deals also with the way of intervention of the international community into the on-going conflict. Finally, the work includes the summary of differences on the internal position and also the international attitude to the progress of armed conflicts.
