The Issue of Private Security Services with the Point of View of The Penalty Law

Abstract:

Ve své bakalářské práci se zabývám především možností provozování soukromých bezpečnostních činností v ČR zejména z hlediska trestněprávního ale také z pohledu občanskoprávního a živnostenského, tedy možnosti provozovat tyto činnosti na komerčním základě. Hned v úvodu se zmiňuji o důvodech výběru vlastního tématu a jeho významu pro mou osobu z hlediska profesního. V první kapitole si všímám celkové bezpečnostní situace v ČR z obecnějšího pohledu. Snažím se zde uvést její současný stav, příčiny tohoto stavu, a zejména pohled a postoj občanů k této situaci. Dále pak jsou popsány cíle bezpečnostních zásad a taktéž postoj občanů a organizací k nim. Je zde uveden přístup a chápání bezpečnostní problematiky občany ale i organizacemi. Čím dál více si oba subjekty uvědomují, že otázky bezpečnosti nelze řešit samostatně, jako jednotlivé problémy ale komplexně v souvislostech. Následná kapitola popisuje strukturu bezpečnostního systému v ČR. Je zde vyzdvihnut a popsán zejména význam a úloha Policie České republiky a obecních policií. Problematice soukromých bezpečnostních služeb je v tomto smyslu věnována samostatná kapitola. Zdůrazňuji zde, že celý bezpečnostní systém může perfektně fungovat nejen jestliže perfektně funguje každý jeho subsystém ale, že musí současně existovat funkční koordinace mezi nimi. Na tuto kapitolu bezprostředně navazuje kapitola, ve které se zabývám popisem možnosti provozovat výše zmíněné činnosti v ČR, zejména z hlediska oprávnění a aplikace současných právních norem na tuto činnost. Jsou zde vyjmenovány konkrétní ustanovení trestního zákona a trestního řádu s podrobným rozborem, o která se především opírá činnost soukromých bezpečnostních služeb v oblasti trestně právní. Další kapitola se věnuje pohledu na provozování bezpečnostních činností, v tomto případě detektivních služeb v jiných demokratických státech. Jedná se především o členské státy EU jako je Francie, Nizozemí, Polsko ale především nám nejbližší Slovensko, kde příslušná legislativa již úspěšně funguje několik let. Za nejdůležitější a nejpodstatnější část mé bakalářské práce považuji kapitolu o důvodech nutnosti přijetí zvláštního zákona v této oblasti. Úvodní článek kapitoly se zabývá historií předkládání návrhu a jeho cesta vládními a zákonodárnými institucemi. Dále jsou popisovány věcné důvody k přijetí zvláštní právní normy. Zejména se jedná o specifičnost oboru soukromých bezpečnostních činností, vlivu a vstupu těchto činností do života občanů hlavně v oblasti základních lidských práv a svobod a jiné. V neposlední řadě jsou zde zmíněny základní principy navrhované právní úpravy, kdy je nutné např. taxativně vymezit oprávnění pracovníků soukromých bezpečnostních služeb, stanovit zvláštní odbornou způsobilost pro tyto pracovníky a v neposlední řadě stanovit působnost ministerstva při rozhodování o licencích a vykonávání dohledu nad touto činností. Jsou zde také popsány všechny aspekty, které byly brány v úvahu při tvorbě tohoto návrhu. V závěru se znovu vracím ke krátkému shrnujícímu popisu významu soukromých bezpečnostních služeb a vyjadřuji své přání k co možná nejvčasnějšímu přijetí příslušného zákona.

Abstract:

In my dissertation, I deal with the possibility of running private security activities in the CR, especially in terms of criminal law, but also in terms of civil and trade laws - possibilities to operate these activities on a commercial basis. In the introduction, I give reasons for the selection of the subject in question, and of its importance to me personally from the professional point of view. In the first chapter, I pay attention to the overall security situation in the CR from the general point of view. I seek to give its current state, causes of the state, and especially a view and an attitude of citizens towards the situation as such. Furthermore, there are described goals of security principles as well as the attitude of citizens and organizations towards them. An approach to the points at issue and their understanding both by citizens and organizations are mentioned. The two entities come to realize more and more that the issues of security cannot be solved separately as single problems, but in a comprehensive way in context. The following chapter describes the structure of the security system in the CR. Significance and the role of the Police of the Czech Republic and the municipal police are described here and emphasized. There is one separate chapter devoted to the problems of private security services in this sense. I point out that the whole security system can perfectly work not only if its subsystem works perfectly, there must concurrently be a functional co-ordination between them, too. This chapter is immediately followed by the chapter in which I deal with the description of the possibility to run the aforementioned activities in the CR, particularly in terms of authorization and application of contemporary legal norms to this activity. There are listed specific provisions of the Criminal Law and Rules of Criminal Procedure with a detailed analysis on which the activity of private security services is based in the sphere of criminal law. Next chapter is dedicated to the view of running security activities, in this case detective services in other democratic countries. Member states of the EU such as France, the Netherlands, Poland, but above all the closest country Slovakia where appropriate legislation has already been successfully implemented for several years. I consider the chapter on reasons for the necessity of adoption of a special act in this area to be the most important and essential part of my dissertation. The introductory article of the chapter deals with the history of submission of a bill and its procedure through government and legislative channels. Next, there are described matter-of-fact reasons for the adoption of a special legal rule. Especially, particularity of the field of private security activities, influence and interference of these activities in citizens life, mainly in the areas of basic human rights and freedoms, and other. Last but not least, there are mentioned basic principles of the proposed legal regulations: it is necessary, for instance, to enumeratively define authorization of private security services workers, to determine a qualification for these workers, and last but not least to determine the sphere of authority of the ministry the decision-making on licences and the performance of inspection over this activity. There are also described all aspects which were taken into consideration at the formation of this proposal. In the end, I go back again to the summary of the importance of private security services, and I express my wish for an appropriate act to be passed as soon as possible.
