The Slovak pensions saga from the perspective of the concept of Europeanization

Abstract:

Práce je případovou studií, která zkoumá sérii rozhodnutí Ústavního soudu a Nejvyššího správního soudu ve věci tzv. slovenských důchodů, a to z pohledu konceptu evropeizace. Kauza slovenských důchodů představuje jednu z významných ság v rozhodování Ústavního soudu, která charakterizuje jeho vztah k evropskému právu a EU samotné. Práce nejdříve konkretizuje koncept evropeizace pro oblast práva a následně aplikuje takto vymezený teoretický rámec na ságu, a to v celé její souvislosti. Podstatnou součástí práce je také charakteristika jednotlivých rozhodnutí, a to jak z hlediska jejich obsahu, tak vzhledem k prvkům relevantním z pohledu evropeizace.

Abstract:

The thesis is an empirical study which deals with a series of judgements of the Constitutional Court and The Supreme Administrative Court in the case of so-called „Slovak pensions“ from the point of view of the concept of Europeanization. The cause of Slovak pensions presents one of the important sagas in the decision making of the Constitutional Court that characterizes its relationship towards the European law and the EU itself. The thesis firstly concretizes the concept of Europeanization for the area of law and subsequently applies the stated theoretical frame to the saga in all its consequences. The important part of the thesis is also the characteristic of the judgements, both from the point of view of their contents and according to the subjects relevant from the viewpoint of the Europeanization.
