Abstract:

Diplomová práce pojednává o státní správě soudů. Úvodní kapitola díla vymezuje pojem a předmět státní správy soudů. Stručně je věnováno vývoji právní úpravy státní správy na našem území od roku 1918. Samostatná kapitola rozebírá současnou právní úpravu. Nechybí ani reformní návrhy některých ministrů spravedlnosti na vylepšení současného stavu správy soudu. Práce kritizuje některé činnosti orgánů státní správy. Zvláštní pozornost je zaměřena na výkon ministerstva spravedlnosti, předsedy soudů a ředitele správ. Krátká kapitola popisuje výkon státní správy okresního soudu v praxi. Nezbytnou součástí práce je prezentace a charakteristika evropských modelů státní správy soudů, především modelů samostatné profesní samosprávy. Osmá kapitola definuje pojem samosprávy soudnictví a zmiňuje její výhody a nevýhody. Základním prvkem soudní samosprávy je v mnoha evropských státech Nejvyšší soudní rada, jejíž konstituování, kompetence a kontrola se v jednotlivých evropských zemích liší. Diplomová práce komparuje tyto odlišnosti. Závěrečná kapitola řeší alternativní přístupy optimálního modelu státní správy soudů.

Abstract:

This diploma thesis discusses the state administration of courts. The introductory chapter defines the concept and the subject of the state court administration. A brief part is devoted to the development of the state administration in the Czech Republic since 1918. A separate chapter examines the current legal system. This diploma thesis also includes proposals of several Ministers of Justice to reform and improve the justice system and the present state administration of courts. Some activities of the state administration are critically examined. Special attention is focused on the performance of the Ministry of Justice, the presidents of court and the directors of administration. A short chapter describes the execution of state administration of a district court in practice. A necessary part of the diploma thesis is presentation and characteristics of the European models of state administration of courts, especially the models of separate professional autonomy. The eighth chapter defines the term of judiciary autonomy and mentions its advantages and disadvantages. The essential element of the judicial authorities in many European countries is the Supreme Judicial Council, which is different in its constitution, competence and control in the individual European countries. This diploma thesis compares these differences. The final chapter deals with the alternative approaches of the optimal model of the state administration of courts.
