Legal regulation of utility infrastructure

Abstract:

Téma bakalářské práce je „Inženýrské sítě ve světle platné právní úpravy“. Práce řeší problematiku konkrétních typů inženýrských sítí a jejich definice a místo v právním řádu. Jejím cílem je obecně vyložit proces zřizování inženýrských sítí, a to z pohledu práva hmotného i procesního. Práce tak nejdříve definuje jednotlivé typy inženýrských sítí s ohledem na příslušné právní předpisy a dále popisuje hmotněprávní instituty jako stavba, stavba na cizím pozemku a služebnost inženýrské sítě. Následně navazují otázky procesního práva, a to zřizování a umisťování inženýrských sítí. S ohledem na obsáhlost tématu se v těchto pasážích práce zaměřuje zejména na „elektroenergetická“ vedení. Pro větší srozumitelnost i pro jeho zajímavost je stěžejní část práce uzavřena příkladem z praxe. Smyslem této práce je předložit čtenáři ucelenou informaci o pojmu inženýrských sítí, o procesu jejich zřizování a o právní úpravě, která se k této problematice váže.

Abstract:

The topic of this bachelor‘s thesis is „Legal regulation of utility infrastructure”. The thesis deals with specific types of utility infrastructure and their definitions and their position in the legal code. The aim is to put an interpretation on process of realization of utility infrastructure from the point of view of substantive and procedural law. Therefore firstly the thesis defines individual types of utility infrastructure with regard to relevant legislation and secondly describes institutes of substantive law as realty, realty built on the land of another and servitude of utility infrastructure. Then the issues of procedural law follow, in particular realization and location of utility infrastructure. In view of the fact that the topic is quite broad the thesis focuses especially on “electro-energetic” lines in these passages. To better understanding the topic as well as for its interestingness a practical example makes the final part of the thesis. The main point of this thesis is to give reader comprehensive information on the term of utility infrastructure, on the process of their realization and on the relevant legislation.
