The role of Frontex in managing the European migrant crisis

Abstract:

Hlavním cílem této diplomové práce je formulování zjištění, zda agentura Frontex provádí svou činnost v rámci příslušných právních mezí, zda svými zásahy neohrožuje lidská práva a zda je právní i faktická ochrany vnějších hranic EU správně koncipována. Úvodní teoretická část práce zkoumá nejen vznik, vývoj a hlavní oblasti působení Frontexu, ale i transformaci této agentury v důsledku evropské migrační krize. V hlavní části práce je analyzována praktická spolupráce Frontexu s členskými státy EU i s tzv. „třetími zeměmi“, jeho financování, personální zastoupení a v neposlední řadě i jednotlivé případy zkoumané Evropským veřejným ochráncem práv, ve kterých byl Frontex nařčen z porušování lidských práv. Vedle analýzy je zde použita také metoda komparace, a to především při porovnávání teoretických zásad a pramenů práva s realitou. V závěru se nachází kritické zhodnocení celého konceptu této agentury, odpovědi na stanovené hypotézy a doporučení pro budoucí vývoj.

Abstract:

The crucial objective of this diploma thesis is to ascertain whether Frontex operates within the relevant legal limits, whether its intervention does not jeopardize human rights and whether the protection of EU external borders is correctly drawn up (both legal and practical aspects). The introductory theoretical part examines not only the origin, development and fundamental function of Frontex but also the general criticism and the future development of this Agency. The key part of the thesis analyzes the individual cases investigated by the European Ombudsman, in which Frontex was accused of violations of human rights. Besides the analysis, the comparison method is also used, especially when comparing the theoretical principles and the sources of law with reality. In conclusion, there is a critical assessment of the agency's overall concept, answers to the stated hypothesis and recommendations for future development.
