Settlement of claims from the Motor Third Party liability insurance

Abstract:

Bakalářská práce na téma „Likvidace pojistných událostí z POV“ je zaměřena nejen na právní prostředí upravující toto pojištění, ale také na uspořádání likvidačních procesů. Praktická část je věnována vysvětlení nejdůležitějších pojmů, problematice stanovení a výpočtu náhrady škody v praxi, a to zejména náhrady škody na motorovém vozidle. Zahrnuty jsou také základní změny, ke kterým došlo účinností nového občanského zákoníku a jejich porovnání s původní právní úpravou. Práce zkoumá zda vývoj od roku 1999 směřuje, zejména z pohledu poškozeného, k posílení jeho práv a postavení. V závěru jsou shrnuty klíčové otázky tématu a nechybí návrh jedné z variant možného řešení.

Abstract:

My thesis called Settlement of Claims from the Motor Third Party Liability Insurance is focused not only on the legal environment regulating this kind of insurance but also on the arrangement of the claim settlement processes. The practical part explains the most important expressions and terms. Further more it covers the determination and the calculation of the damage compensation in practice, mainly the compensation of a damage caused on a motor vehicle. There are also included main changes arising due to the effectiveness of the new Civil Code and their comparison with the original legal framework. The thesis surveys whether the development since 1999 is directed, mainly from the point of view of the injured party, at the strengthening of his/her rights and status. In the conclusion there are summed up key questions of the issue and a suggestion of a possible solution.
