Cílem práce je přiblížit institut omezení svéprávnosti z pohledu hmotného i procesního práva s důrazem na dokazování a důkazní prostředky. Práce analyzuje pojmy se svéprávností související, včetně podpůrných opatření, která ze své podstaty omezení svéprávnosti předcházejí. Práce vychází z judikatury Evropského soudu pro lidská práva. The aim of the diploma thesis is to introduce limitation of legal capacity from the perspective of the substantive and procedural law with the accent to the evidence. The diploma thesis analyses terms connected with legal capacity including supportive measures in case of disruption of the capacity to act, which should take priority over limitation of legal capacity.
