The Role of Forensic Medicine in the Criminal Evidence Proceedings

Abstract:

Diplomová práce na téma „Role soudního lékařství v trestně procesním dokazování“ se zabývá úlohou soudního lékaře jakožto znalce při objasňování skutečností důležitých pro trestní řízení. Práce je členěna do tří hlavních částí. V první části je představen obor soudní lékařství jako takový a je zde uvedena právní úprava znalecké činnosti u nás i v zahraničí. V druhé části se práce snaží přiblížit metody a činnosti, které jsou soudními lékaři využívány při objasňování trestných činů. V poslední část je věnována případům z praxe a posouzení vlivu znaleckého posudku soudního lékaře na rozhodnutí soudce v konkrétních případech. V závěru práce jsou uvedeny závěry a doporučení de lege lata a de lege ferenda.

Abstract:

The thesis titled "The Role of Forensic Medicine in the Evidence in Criminal Proceedings" deals with the role of a forensic doctor as an expert in the clear-up of the facts important for the criminal proceedings. The thesis is divided into three major parts. The first part presents the field of forensic medicine as such and states the legal regulation of the expert activities both in our country and abroad. The second part attempts to describe the methods and activities applied by the forensic doctors in the solving of crimes. The final part is dedicated to the practical cases and to the evaluation of the influence of an expert report drawn up by a forensic doctor to the decision issued by the judge in the particular cases. The end of the thesis contains the conclusions and recommendations de lege lata and de lege ferenda.
