Abstract:

Diplomová práce se zabývá problematikou „Práva na informace ve veřejné správě“. Právo na informace má oporu v legislativě, především v zákoně č. 106/1999 Sb., o svobodném přístupu k informacím. Veřejná správa je dnes ovlivněna rozvojem moderních technologií, což vede ke stále rychlejší a přehlednější dostupnosti informací. Práce se zaměřuje na způsob, jak povinné subjekty, na základě platné legislativy, podávají informace občanům. Pravidelný tok informací je nezbytnou součástí života občanů v České republice ale i občanů v Evropské unii. Práce se právě touto problematikou zabývá. Diplomová práce dále analyzuje a srovnává právní úpravu zákona o svobodném přístupu k informacím ve Slovenské republice a v České republice. Teoretické poznatky jsou doplněny konkrétními příklady a rozhodnutími Nejvyššího správního soudu a Ústavního soudu.

Abstract:

The diploma thesis deals with the following issue: The right to demand information in public administration. The right to demand information is grounded in legislation, especially in the law No. 106/1999 Coll. about free access to information. Nowadays public administration is influenced by the development of modern technology, which leads to faster and more transparent availability of information. The thesis is focused on the method that compulsory legal entities use to share information with their citizens on the basis of legislation. The regular flow of information is indispensable part of life of citizens not only in the Czech Republic but in the European Union as well. The thesis deals with this issue. Moreover, the diploma thesis analyses and compares legal modification of the law about free access to information in the Slovak Republic and Czech Republic. The theoretical findings are supplemented with examples and decisions of the Supreme Administration Court and Constitutional Court.
