Abstract:

Diplomová práce se zabývá problematikou překážek v práci na straně zaměstnance. Úvodní část práce se zabývá definováním pracovněprávních vztahů se zaměřením na práva a povinnosti subjektů při vzniku překážek v práci. Hlavní část práce se věnuje překážkám v práci na straně zaměstnance, kde rozebírá jejich aktuální právní úpravu. Práce klade důraz na dělení překážek v práci na straně zaměstnance, kde podtrhuje a vymezuje jednotlivé překážky. U jednotlivých překážek v práci pak zvýrazňuje nárok zaměstnance na pracovní volno a na odměnu. Diplomová práce také zmiňuje o současné situaci ovlivněné pandemii COVID-19 a jejími dopady na institut překážek v práci na straně zaměstnance. Závěrečná část práce se věnuje srovnání právní úpravy překážek v práci na straně zaměstnance v České republice a ve Francii, za účelem porovnání podmínek, které jsou zaměstnancům během překážek v práci poskytovány. Cílem diplomové práce je celkové objasnění problematiky překážek v práci na straně zaměstnance a zjištění, jak jsou dle české právní úpravy zaměstnanci chráněni při vzniku překážek na jejich straně, a to i pomocí srovnání s jiným členským státem Evropské unie.

Abstract:

The diploma thesis deals with the issue of work obstacles on the side of the employee. The initial part of the thesis deals with the definition of labor relations with a focus on the rights and obligations of entities in the event of obstacles at work. In the main part of the thesis is discussed the current legislation of work obstacles on the side of the employee. The thesis emphasizes the division of work obstacles on the side of the employee, where it also underlines and defines the individual obstacles. In the case of particular obstacles at work, it emphasizes the employee's right to time off work and remuneration. The diploma thesis also mentions the current situation affected by the COVID-19 pandemic and its effects on the institute of obstacles at work on the side of the employee. The final part of the thesis deals with the comparison of the legal regulation of obstacles at work on the side of the employee in the Czech Republic and in France, in order to compare the conditions that are provided to employees during obstacles at work. The aim of the diploma thesis is a general clarification of the issue of obstacles at work on the side of the employee and finding out how employees are protected under Czech law when obstacles arise on their part, also by using the comparison with another member state of the European Union.
