Abstract:

Diplomová práce je zaměřena na problematiku ukončování pracovního poměru. Pracovní poměr může být ukončen výhradně způsobem, který je uveden v zákoníku práce. Každý z těchto způsobů má svá specifika a různé právní důsledky. Tato práce jednotlivé způsoby přesně vymezuje a rozlišuje. Krom toho jsou dále charakterizovány instituty související s ukončením pracovního poměru a popsány důsledky neplatného ukončení pracovního poměru. Hlavním cílem diplomové práce je pak upozornit na spory vznikající při ukončování pracovního poměru, přičemž východiskem jsou rozsudky Nejvyššího soudu České republiky.

Abstract:

This thesis is targeted on the issue of the termination of employment. Employment may be terminated only in ways that are listed in the Labour Code. Each of these methods has its specifics and different legal consequences. This work different ways of accurately defines and distinguishs. In addition, there are further characterized institutes associated with the termination of the employment and describe the consequences of an invalid termination of employment. The main objective of this thesis is to draw attention to the disputes arising from the termination of employment, starting with the judgments of the Supreme Court of the Czech Republic.
