State Property Management with Regard to Detained and Confiscated Specimens

Abstract:

Cílem této práce je podat jejímu čtenáři ucelenou informaci o jedné specifické skupině majetku, kterou jsou exempláře, definované jako jedinci rostlin či živočichů (živé i neživé), jejich části, odvozeniny nebo výrobky z nich. Charakterizuje tento majetek, jeho rozmanitost, jeho hodnotu z hlediska biodiverzity i hodnotu jako majetku. Popisuje procesní způsoby, kterými stát tento majetek může nabýt do vlastnictví, dále péči o něj v průběhu správních řízení a hospodaření s ním po jeho nabytí. Blíže se věnuje nákladům spojeným s péčí o něj, vynaloženým ze státního rozpočtu, a možnosti vrácení těchto nákladů prostřednictvím uložení jejich úhrady osobám, které situaci způsobily porušením právních předpisů. Specifikuje možná úskalí tohoto procesu a nastiňuje možnosti jejich řešení.

Abstract:

This work offers its reader integrated information about one specific type of property, which are specimens, defined as plants or animals (both dead and living), their parts, derivates or products made of them. It characterizes this property, its diversity, its value in terms of biodiversity and its value as property. It describes procedural ways by which the state can take ownership of this property, then taking care of it during administrative proceedings and managing it after the ownership was taken. Specifically, it devotes to care costs paid from the state budget and to the possibility of returning the expenses back from those who caused the situation by violating the law regulations. It specifies potential pitfalls of this process and outlines possible ways of solving them.
