Approaches to the Regulation of the Collaborative Economy in Accommodation Services

Abstract:

This thesis deals with the regulation of the collaborative economy in accommodation services. The thesis is divided into three main parts, namely: theoretical, analytical and proposal. The main objective is to propose possible regulatory measures to prevent short-term rentals and to align with the conditions of standard business in accommodation services in the Czech Republic. Several research methods are used in the thesis: analysis, comparison, deduction and synthesis. The subject of the analytical part of the thesis is the regulatory approaches of short-term rentals via digital platforms in selected European countries. The aim of the analytical part is to find out whether the regulation of short-term rentals helps countries in their efforts to straighten out the business environment of traditional accommodation service providers with short-term rentals via digital platforms, and to find out what regulatory approaches the selected European countries have chosen. Consequently, based on the findings in the analytical section, the stated hypothesis is confirmed: "The regulation of short-term rentals in the selected countries helps to straighten the business environment between short-term rental providers via the Airbnb platform and traditional accommodation service providers." As a result of the findings of the analytical part of the thesis, several regulatory approaches are defined that European countries have used. In the proposal part of the thesis, according to the examined regulatory approaches of European countries, regulatory changes are proposed, which are aimed at solving the problems with the lack of regulation of short-term rentals through digital platforms in the Czech Republic. Thanks to the conducted analysis, the author concludes that the provision of short-term rentals via digital platforms is a form of accommodation service, but considers it important to create reasonable regulatory standards that will be adapted to the nature of the activity. The proposals presented mainly concern the definition of the activity, the creation of a registration system and the division of providers into amateurs and professionals, and consequently the definition of different conditions for carrying out the activity.

Abstract:

Táto diplomová práca sa zaoberá reguláciou kolaboratívnej ekonomiky v ubytovacích službách. Diplomová práca je rozdelená do troch hlavných častí, a to: teoretickej, analytickej a návrhovej. Hlavným cieľom je navrhnúť možné regulatívne opatrenia k zamedzeniu krátkodobých prenájmov a narovnaniu s podmienkami štandardného podnikania v ubytovacích službách v Českej republike. V práci je využívaných niekoľko výskumných metód: analýza, komparácia, dedukcia a syntéza. Predmetom analytickej časti práce sú regulatívne prístupy krátkodobých prenájmov cez digitálne platformy vo vybraných európskych krajinách. Zámerom analytickej časti je zistiť či regulácia krátkodobých prenájmov pomáha krajinám pri snahe narovnať podnikateľské prostredie tradičných poskytovateľov ubytovacích služieb s krátkodobým prenájmom cez digitálne platformy, a zároveň zistiť aké regulatívne prístupy vybrané európske krajiny zvolili. Následne, je na základe zistení v analytickej časti potvrdená stanovená hypotéza: „Regulácia krátkodobých prenájmov vo vybraných krajinách pomáha narovnať podnikateľské prostredie medzi poskytovateľmi krátkodobých prenájmov cez platformu Airbnb a tradičnými poskytovateľmi ubytovacích služieb.“ Výsledkom zistení analytickej časti práce je definovanie niekoľko regulatívnych prístupov, ktoré európske krajiny využili. V návrhovej časti práce sú podľa vyskúmaných regulatívnych prístupov európskych krajín navrhnuté regulatívne zmeny, ktoré sú zamerané na vyriešenie problémov s nedostatočnou reguláciou krátkodobých prenájmov cez digitálne platformy v Českej republike. Autor, vďaka vykonanej analýze, dospel k názoru, že poskytovanie krátkodobých prenájmov cez digitálne platformy je formou ubytovacej služby, avšak považuje za dôležité vytvoriť rozumné regulatívne normy, ktoré budú prispôsobené charakteru činnosti. Prezentované návrhy sa týkajú hlavne definovania činnosti, vytvorenia registračného systému a rozdelenia poskytovateľov na amatérov a profesionálov a následne definovanie rozdielnych podmienok pre vykonávanie činnosti.
