Anotace:

Bakalářská práce na téma Ochrana spotřebitele na finančních trzích pojednává o problematice ochrany spotřebitele, konkrétně v oblasti spotřebitelských úvěrů bankovních a nebankovních společností. Práce se zprvu zabývá potřebnými definicemi a vymezeními spotřebitele a ochrany spotřebitele podle platné právní úpravy, finančního trhu a subjektů v něm vystupujících, dále konkrétně spotřebitelským úvěrem bankovních a nebankovních institucí a popisuje orgány dohledu nad finančním trhem. Důraz je kladen na popsání spotřebitelského úvěru jako produktu, povinností a práv spotřebitele i poskytovatele úvěru, náležitostí platného uzavření a ukončení smluvního vztahu a ochrany spotřebitele proti zakázaným obchodním praktikám. Práce rovněž rozebírá možnosti soudní a mimosoudní obrany spotřebitele proti protiprávním jednáním poskytovatele spotřebitelského úvěru. Práce dále objasňuje, zda vyřčená hypotéza je skutečně platná, obsahuje podrobnější rozbor vybraných sporů projednávaných před finančním arbitrem a komparaci přístupů mimosoudního řešení sporů v jiných státech Evropské unie i mimo ni.

Abstract:

The bachelor thesis on the topic of Consumer protection in financial markets describes the issue of consumer protection, specifically in the area of consumer credit of banking and non-banking institutions. The thesis firstly deals with the necessary definitions and definitions of the consumer and consumer protection according to the current legislation, the financial market and the entities acting in it. Then it explains specifically consumer credit of banking and non-banking institutions and describes the supervisory authorities of the financial market. The focus is on the description of consumer credit as a product, the obligations and rights of the consumer and the credit provider, the requirements for the conclusion and termination of the contractual relationship and the protection of the consumer against prohibited commercial practices. The thesis also discusses the possibilities of judicial and extrajudicial defence of the consumer against illegal practices of the consumer credit provider. The thesis further clarifies whether the hypothesis expressed is valid, contains a detailed analysis of selected disputes heard before a financial arbitrator and a comparison of out-of-court dispute resolution approaches in other EU and non-EU countries.
