Intrastat, customs clearance process

Abstract:

Diplomová práce se zabývá procedurální stránkou přijetí a odeslání zboží v rámci EU – Intrastatem a vývozem a dovozem ve vztahu ČR a třetích zemí – Celním řízením. V teoretické části jsou objasňovány principy fungování a postupů u obou systémů, což vytváří možnost určitého srovnání mezi sebou. U Celního řízení jsou rozebírány nutné předpoklady pro realizaci vývozu a dovozu a souvisejících okolností, zejména význam celní hodnoty, její možná korekce, vznik, zajištění a zánik celního dluhu. Navazující praktická část se snaží detekovat skutečný stav věcí, který je odlišný od optimálního zákonného stavu, ať už základě neznalosti zákonů nebo i úmyslného porušování povinností. Je zde proveden rozbor potíží zvlášť u vývozu a dovozu. Mnohé potíže v celé EU činí i levné dovozy vybraných komodit z Číny, čemuž se věnuje kapitola podhodnoceného zboží. Každý okruh problémů, který tvoří základ Celního řízení, má uveden i několik možných řešení pro nápravu. Z hlediska Intrastatu se nejedná na rozdíl od Celního řízení ani tak o finanční ztráty, protože je to systém sbírání dat a statistiky, přesto dílčí potíže z hlediska systému i uživatelské veřejnosti se taktéž objevily.

Abstract:

This thesis examines the procedure of sending and acceptance of goods in the EU – Intrastat and export and import in the frame of the thirds countries – Customs Clearance. There are described the principles of the rules of the both systems with the posibility to compar it in the theoretical part. In the case of the Customs Clearance are mentioned obligatory assumptions for the realization export and import included the next important circumstances of the meaning of the customs value and its correction, the emergance, ensure and the demise of the customs debt. There is described the real state of affairs which does not correspond to the rules and law. This could be caused by the low level of knowledge or the intentional conduct. There are detailed the hypothetical problems of the import and the export. Several problems in the EU are caused by the imports with low price products from China. Each topic of the Customs Clearance contains own sugestion as a solution. In the case of the system of Intrastat there are different problems, explanatory value or for example in the case of the knowledge of the user public.
