Abstract:

V této diplomové práce je vymezena sféra práva a morálky. Je zde popsán pojem sociální norma z hlediska právní sociologie a vymezen prostor morálním a právním normám v systému norem sociálních. Dále se práce věnuje problematice morálky z pozice etiky, jako vědní disciplíny. Je zde vyznačena struktura a význam výrazu „etika“, „morálka“, „morální norma“. V práci jsou uvedeny definice pojmů „právo a právní norma“ a je zdůrazněn fakt různého nazírání na právo z pohledu práva přirozeného a pozitivního. Následně jsou popsány formální rozdíly mezi normou morální a právní a poměr mezi právem a morálkou.

Abstract:

In this diploma thesis is delimited an area of law and moral. It describes an idea social norm from the view of legal sociology and the work delimits a space to the moral and legal norms in system of the social norms. The work engages in the problems of morality from the position of ethics like the scientific discipline. There is marked the structure and the value of the expressions “ethic”, “morality”, “moral norm” in this work. There are definitions of the expressions “the law and the legal norm” too and it is highlighted the fact of different ways to law from the point of view of the natural and positive law. There are described formal differences between the moral and legal norm and the condition between law and morality.
