Debt collection by the Czech Social Security Administration and factors influencing their collection

Abstract:

Cílem této diplomové práce je charakterizovat a analyzovat vymáhání pohledávek České správy sociálního zabezpečení a faktory ovlivňující jejich výběr. Teoretická část je členěna do tří kapitol. První kapitola obsahuje obecné informace o České správě sociálního zabezpečení a její působnosti. Další kapitola zahrnuje exekuční tituly, rozdíl mezi soudním a správním výkonem rozhodnutí a rovněž přibližuje jednotlivé druhy správních exekucí. Třetí kapitola popisuje zajištění pohledávek a faktory, které ovlivňují proces vymáhání. Praktická část analyzuje vývoj pohledávek České správy sociálního zabezpečení v posledních pěti letech, a to i ve splátkovém režimu, včetně zhodnocení úspěšnosti výběru, a komparaci vydaných správních exekucí jednotlivých pracovišť. Analyzovány jsou také úspěšnost vymáhání v insolvenčním řízení a prominutí penále. Na základě těchto výsledků jsou navrhována možná doporučení v oblasti vymáhání pohledávek. V práci jsou použity metody deskripce a komparace.

Abstract:

The aim of the thesis is to characterize and analyze the enforcement of claims by the Czech Social Security Administration and the factors influencing their collection. The theoretical part is divided into three chapters. The first contains general information about the Czech Social Security Administration and its scope of activities. The next chapter covers foreclosure titles, the difference between judicial and administrative enforcement of decisions and introduces various types of administrative foreclosures. The third chapter describes the securing of claims and the factors influencing the enforcement process. The practical part analyzes the development of claims by the Czech Social Security Administration over the past five years, including installment arrangements, with an evaluation of the success rate of collections and a comparison of administrative foreclosures issued by different offices. The success of collections in insolvency proceedings and penalty waivers are also analyzed. Based on these results, possible recommendations regarding claims enforcement are proposed. The methods of description and comparison are used in the thesis.
