Supremacy and Primacy of EU Law

Abstract:

Práce se věnuje nadřazenosti a přednosti unijního práva ve vztahu k vnitrostátnímu právu členských států. Jejím cílem je především vymezit, co se rozumí pod zásadou přednosti unijního práva a pomocí rozboru nejvýznamnějších rozhodnutí zabývajících se touto otázkou ukázat, jaký pohled na tuto zásadu zastává Soudní dvůr Evropské unie jako její tvůrce a jaký názor na ni mají naopak vybrané členské státy, respektive jejich soudní orgány. V práci je též mimo jiné rozebrána problematika zaměňování pojmů přednost a nadřazenost, výjimky z principu aplikační přednosti a důsledky, které má zásada přednosti pro neslučitelný vnitrostátní předpis.

Abstract:

This thesis deals with supremacy and primacy of the law of the European Union in relation to the laws of the member states. Its aim is to define, what shall be understood under the principle of primacy of the law of the European Union and to present, by analysing the most significant decisions dealing with this issue, how this principle is viewed by the Court of Justice of the European Union, as the author of this principle, and by some of the member states, respectively their judicial bodies. The thesis analyses the difference between the terms supremacy and primacy, exceptions to the primacy principle and consequences of this principle with respect to incompatible national regulations.
