Abstract:

Abstrakt. Těžiště výzkumu této práce spočívá v odhalení příčin vzniku staveb umísťovaných na cizím pozemku. Důležitým aspektem je analýza historických příčin, historických právních úprav v kontextu tehdy aplikovaných politických doktrín. Rovněž aktuální pohled na umísťování staveb na cizím pozemku je v komparaci s historickým náhledem zpracován i s komentáři na aktuální právní úpravu, její možné využití v běžném životě. Použité výzkumné metody spočívaly ve studiu aktuální právní úpravy, právních úprav předešlých i historických, rozhodovací praxe aplikačních orgánů, soudů, judikatury. Prameny výzkumu spočívaly také v odborných článcích a pojednáních o době vzniku Československé republiky v kontextu s celkovým společenským vývojem. Výsledkem výzkumu je práce, jenž analyzuje důvody, tedy proč, výhody a nevýhody, stavby umístěné na cizím pozemku, také hledá a nabízí možné řešení kolizní vlastnických práv k pozemku a ke stavbě na cizím pozemku. Závěrem lze konstatovat, že se podařilo odkrýt příčiny, souvislosti vzniku stavby na cizím pozemku. V návaznosti na to, se také podařilo stanovit doporučení, jak řešit kolizní situace, jak se kolizním situacím vyhnout. V práci je také obsaženo doporučení, jak do budoucna postupovat při umísťování stavby na cizím pozemku.

Abstract:

Abstract. The subject matter of the research in this project is to reveal the causes of buildings situated on the land of another. An important aspect is an analysis of historical reasons and historical legislation in the context of the political doctrines applied in the past. A current opinion of the placement of buildings on the land of another is discussed and compared to the opinion of the past including comments to the effective legislation and its application in a real life. The research methods applied consisted in analysing the current legislation, the respective previous legislation including the historical legislation, decision-making of the bodies in charge, courts and judicature. Among the sources of information were also professional articles and essays about the period when the Czechoslovak Republic was established in the context of the then social development. The outcome of the research is the project, which analyses the causes as well as the pros and cons of buildings placed on the land of another and which also looks for and suggests a solution to the conflict of ownership rights to the land and to the building on the land of another. In conclusion it may be stated that the causes of buildings situated on the land of another have been revealed. Recommendations are made how to deal with conflicts and how to avoid them. The project also suggest how to proceed in the future should a building be constructed on the land of another.
