Plea Bargaining from the Point of View of Theory and Practise

Abstract:

Tato diplomová práce se zabývá relativně nově zavedeným institutem v trestním právu, a to dohodou o vině a trestu, který byl do českého trestního práva zaveden novelou trestního řádu provedenou zákonem č. 193/2012 Sb., s účinností od 1. 9. 2012. V úvodní kapitole diplomová práce charakterizuje pojem dohody o vině a trestu a důvody jeho zavedení, začlenění mezi ostatní odklony trestního řízení a taktéž se zabývá vztahem k základním zásadám trestního řízení. Následující kapitola pojednává o dohodě o vině a trestu z hlediska trestního práva hmotného, tedy podmínky jejího sjednání a její náležitosti. Třetí kapitola se věnuje procesu sjednávání, uzavírání a následného schvalování dohody o vině a trestu. Nedílnou součástí diplomové práce je pohled na faktické využívání dohody o vině a trestu z pohledu praxe a úvahy nad návrhy de lege ferenda vedoucí k zlepšení a zefektivnění využití tohoto nového trestněprávního prvku.

Abstract:

This thesis deals with a relatively new institute in criminal law, which is the agreement on guilt and punishment (Plea bargain), introduced in Czech criminal law by the Code of Criminal procedures in act n. 192/2012 coll., effective from 1. 9. 2012. The introduction deals with the main characteristics of this agreement, the reasons for its introduction, its implementation with other diversions of criminal proceedings and also deals with the relationship to the basic principles of criminal proceeding. The following chapter deals with the Plea bargain in terms of substantive criminal law, i.e. the conditions of negotiations and its requirements. The third chapter is devoted to the process of negotiation, conclusions and subsequent approval of the Plea bargain. An integral part of this thesis is an assessment of actual usage of a plea bargain in terms of practice, and consideration of proposals de lege ferenda leading to improvements in the use of this new criminal proceeding.
