The Crime of Neglecting of Compulsory Sustenance in Police Practice

Abstract:

Bakalářská práce se zabývá trestným činem zanedbání povinné výživy v policejní praxi. Úvod práce je zaměřen na základní pojmy výživného a vyživovací povinnosti z hlediska občanského zákoníku. Dále se práce zaměřuje na rozbor trestného činu zanedbání povinné výživy dle ustanovení § 196 trestního zákoníku včetně vymezení zvláštního ustanovení o trestání a účinné lítosti u tohoto trestného činu. Stěžejní kapitolou v této práci je postup policejního orgánu – obvodního oddělení Policie ČR při prověřování trestného činu zanedbání povinné výživy od doby přijetí trestního oznámení přes prověřování, jeho dokazování, až do ukončení prověřování. V závěru práce jsou uvedeny vybrané příklady z policejní praxe.

Abstract:

Thesis deals with the criminal act neglect of mandatory nutrition in the police practice. Introductory part is focused on basic terms from the standpoint of the Civil Code. Following part is analyzing criminal act neglect of the mandatory nutrition under § 196 of the Criminal Code including definition of special provisions about punishing and effective regret in the case of this criminal offence. Most important part of this thesis is the police procedure taken by the district department of the Czech Police in analyzing of criminal act neglect of the mandatory nutrition from the time of adoption of the criminal notice through the time of analysis and its evidence to the closure of the investigation. The conclusion of the thesis consists of selected examples from the police practice.
